UMG filed a ‘scathing motion to dismiss’ Drake’s sad-loser lawsuit

Almost one year exactly, Future and Metro Boomin’s album We Don’t Trust You came out. Immediately, everyone gravitated towards the song “Like That,” which contained a surprise feature from Kendrick Lamar. Kendrick’s feature on “Like That” came after years of back-and-forth sneak-disses and not-so-veiled threats and insults between Kendrick and Drake. Before that song, it had mostly been a Cold War between Drake and Kendrick, but “Like That” went off like a bomb, destroying any semblance of peaceful coexistence. What followed was one of the greatest rap beefs of all time, with Kendrick coming out the clear and unquestionable victor: “Not Like Us” is one of the most successful diss records of all time (if not THE most successful); NLU won multiple Grammys, including Song of the Year and Record of the Year; Kendrick then performed NLU (and Euphoria!!) at the Super Bowl.

Making Kendrick’s victory even sweeter is the fact that Drake is a suckbaby loser who started suing everybody BUT Kendrick in the wake of his rap-beef loss. Earlier this month, Drake ended up “settling” with iHeartMedia after he sued them and accused them of participating in a payola system to promote NLU. Drake’s incel bro fans tried to say that iHeartMedia gave him a financial settlement – that is a lie. Drake dropped the lawsuit after iHeart provided their receipts to show that there was no payola needed for “Not Like Us,” that the song was a huge hit organically. Well, now UMG is trying to get Drake’s lawsuit thrown out. UMG distributed both sides of the rap beef – Kendrick’s music is distributed through pgLang then Interscope then UMG. Drake’s music goes through OVO Sound, then Santa Anna Label Group, then UMG. UMG didn’t play favorites as the beef was happening last year, which was the right thing to do – let it play out, let the fans decide who won and who lost. The fans decided, and Drake didn’t like the outcome, so he sued UMG. Now UMG is getting as petty as possible.

Universal Music Group has filed a scathing motion to dismiss Drake‘s New York lawsuit against them for promoting Kendrick Lamar‘s “Not Like Us,” stating that he’s only suing because he “lost a rap battle” and took legal action to “salve his wounds.”

The motion, filed earlier today and reviewed by Variety, took a cutting approach to making the case for dismissal, claiming that Drake “lost a rap battle that he provoked and in which he willingly participated. Instead of accepting the loss like the unbothered rap artist he often claims to be, he has sued his own record label in a misguided attempt to salve his wounds. Plaintiff’s Complaint is utterly without merit and should be dismissed with prejudice.”

The filing notes that Drake himself signed a public petition less than three years ago criticizing “the trend of prosecutors using artists’ creative expression against them” by interpreting rap lyrics as fact. “Drake was right then and is wrong now,” reads the motion. “Complaint’s unjustified claims against UMG are no more than Drake’s attempt to save face for his unsuccessful rap battle with Lamar.”

In its motion to dismiss, Universal is arguing that Drake fails to make a claim for defamation in his suit, stating that it’s a double standard to expect them to promote his diss tracks against Lamar and not vice versa. The motion adds that “Not Like Us” “conveys nonactionable opinion and rhetorical hyperbole, not fact,” meaning they can’t be accused of acting with malice, and further claims that there’s no basis for the suit since Drake failed to state a claim for “harassment in the second degree” and under New York General Business Law.

In a statement shared with Variety, Drake’s attorney Michael Gottlieb says, “UMG wants to pretend that this is about a rap battle in order to distract its shareholders, artists and the public from a simple truth: a greedy company is finally being held responsible for profiting from dangerous misinformation that has already resulted in multiple acts of violence. This motion is a desperate ploy by UMG to avoid accountability, but we have every confidence that this case will proceed and continue to uncover UMG’s long history of endangering, abusing and taking advantage of its artists.”

[From Variety]

“A greedy company is finally being held responsible for profiting from dangerous misinformation” – motherf–ker, you claimed that Kendrick beats his wife! You claimed that Kendrick’s wife/partner, Whitney Alford, had given birth to Dave Free’s child. You were also too stupid to understand Kendrick’s Mr. Morale album and you wrongly claimed that Kendrick was molested as a child. DANGEROUS MISINFORMATION??? Anyway, possibly the best part of UMG’s filing is when they list all of the reasons why Kendrick’s “certified loverboy/certified PDFile” bar didn’t come out of left field. UMG was like “Misinformation, you say? Here are all the receipts on Drake’s extremely questionable relations with minors.”

Kendrick Lamar’s cute, trendsetting Celine flared jeans are completely sold out

Kendrick Lamar’s Super Bowl Halftime Show was the most-watched Halftime show in history. 133.5 million people tuned in to watch Kendrick, while the game itself averaged 126 million viewers (millions of whom turned off the game after the Halftime show, let’s be real). Kendrick’s Halftime Show isn’t just the most-watched Halftime performance of all time, it’s right up there with “the 1969 Moon Landing” as far as must-see event television.

Obviously, Kendrick’s performance has become a week-long story. People are still watching it, dissecting the messages and analyzing the visuals. But there have also been superficial conversations, notably about Kendrick’s fashion choices. He wore a custom leather jacket by Martine Rose, with “GLORIA” across the chest. Gloria is the name of a song on GNX, a song about his pen. Kendrick’s diamond “a” pendant also got a lot of attention, and most people agree that it is a reference to “a minooooorrrr” in “Not Like Us.” But the biggest fashion conversation is about Kendrick’s cute-ass flared jeans. They’re from Celine, they retail for $1300 and they’re technically women’s jeans. Apparently, Kendrick’s stylist Taylor McNeil sourced the jeans for another client – Timothee Chalamet. The pair Kendrick wore were in women’s size 29, and Kendrick is usually a 33, but they fit Kendrick and he loved them.

Kendrick Lamar’s record-breaking Super Bowl halftime show doubled as a fashion trendsetting moment — his viral bell-bottom jeans are completely sold out!!!

The flared-leg jeans cost $1,200 … and more than 130 million viewers witnessed Kendrick perform inside the Superdome in New Orleans.

French luxury fashion house Celine tells TMZ the pair of jeans Kendrick wore for the historic moment were “Marco” style, in dark union wash denim.

Kendrick was fitted with size 29 women’s … but as you can see, the entire collection is sold out.

Celine and Kendrick’s pgLang brand partnered with the French fashion house in 2022, and as you can see, the relationship has been fruitful.

Kendrick was also rocking Deion Sanders’ famed Nike Air DT Max sneakers, but the masses haven’t caught on yet … the bell-bottoms covered them up!!!

[From TMZ]

It does not surprise me at all that Celine is sold out. It was an immediate shift in denim style, the official end of skinny jean supremacy. The slim-cut era is officially over – flares, boot-cuts and bellbottoms are now back and that goes for men and women. Vogue has even devoted several stories to Kendrick’s jeans and what they mean for fashion trends and whether men will follow Kendrick’s lead (I assume because we know women will follow his lead).

Noel Gallagher thinks Kendrick Lamar’s Halftime show was ‘absolute nonsense’

Noel Gallagher used to be known as one of the biggest haters in the world, and currently he’s mad because Kendrick Lamar has taken the Hater Crown. In recent years, Noel Gallagher has repeatedly slammed Adele, he’s called Prince Harry a “typical f–king woke snowflake,” and he’s mocked “slack-jawed f–kwit” Matt Healy. This week, Gallagher appeared on the talkSPORT show to talk about football (American football and British football). He was asked about the Super Bowl and Kendrick Lamar’s Halftime Show. He had some thoughts.

Kendrick Lamar’s set at the Superdome on Sunday was the most-watched Super Bowl Halftime Show ever, with 133.5 million viewers according to Roc Nation, and Kendrick’s company pgLang is calling it the “Most watched anything in the history of american television.” Among those watching was Noel Gallagher, the notorious hip-hop hater who claimed in 2008 that having rappers at Glastonbury was “wrong,” sparking a funny “Wonderwall” cover during Jay’s set. You won’t be surprised to learn that Gallagher also thought Kendrick’s Super Bowl performance was rubbish.

One thing the Oasis guitarist does love is Manchester City football. He went on Andy Goldstein and Darren Bent’s talkSPORT broadcast to discuss Man City and pivoted to some Super Bowl chatter at the end of his call. He revealed that he’s been a fan of American football since the ’80s and was pretty invested in this season’s playoffs despite not having a favorite team. (“I thought the Commanders were going to do it” — it did seem that way for a while, Noel!) Goldstein then asked Gallagher about Bent’s “hero,” Kendrick Lamar, and the Halftime Show.

“I had to switch it off,” Gallagher said. “It was absolute nonsense.” When pressed about why it was bad, Gallagher said, “It was like 300 people getting out of a car in the first three minutes.” He continued, “But no, I don’t like the halftime nonsense at all. It’s usually artists that I don’t like.” When pressed about his favorite Halftime Show, he said he never watches it. And when asked if he’d like to see that sort of grand production taking place during the UEFA Champions League final, Gallagher replied, “No, and it’s coming. Trust me, it’s coming. Americans are taking over our sport. They’re taking over the Premier League. They’ll take over the Champions League. And it’ll be — 20 years from now it’ll be nonsense.”

[From Sterogum]

I forgot about the “rappers at Glastonbury” thing and Jay-Z mocking Oasis. Kendrick played at Glastonbury too – he played the festival in 2022 to a rapturous crowd and widespread acclaim. I mean, honestly, it sounds like Noel Gallagher is just racist and he fancies himself a music gatekeeper. He doesn’t think rap is “real music,” just my guess. Anyway, Kendrick officially has the most-watched Halftime show in history, and the YouTube video is doing crazy numbers as well. Kendrick’s streaming numbers are going bonkers too. While there are obviously has-been haters like Noel, the overwhelming majority of casual Super Bowl viewers loved Kendrick’s show and they became even more interested in his music and his lore.

Kendrick Lamar dog-walked Drake at the most-watched Super Bowl in history

This past Sunday’s Super Bowl was the most-watched Super Bowl in history. According to Variety, 126 million tuned into the game on average, and the biggest spike in viewership happened during the second quarter, with 135.7 million tuning in. You know, when most people were checking out how much time was left until the Kendrick Lamar concert. I’ve also heard – although it’s not in this report – that the Super Bowl lost millions of viewers after the Halftime show. Which is actually pretty common, but it was even more notable this year.

The NFL never pays their Halftime performers, although I believe the NFL picks up the costs of all of the staging and the dancers and everything. Artists choose to do the Halftime show because they know they’ll get a crazy amount of exposure and a huge bump in sales. That’s exactly what’s happening with Kendrick:

After Sunday’s Super Bowl halftime show, Kendrick Lamar’s music saw a significant jump in streams on Spotify. On Monday, the streaming service announced that the rapper’s music saw a 175 percent spike in the U.S. in the three immediate hours after the game wrapped.

After the performance, Lamar’s streaming numbers saw significant jumps for individual songs from the set list, led by his Grammy-winning Drake diss track “Not Like Us,” which saw a whopping 430 percent jump in streams. Damn‘s “Humble.” went up 300 percent, Black Panther soundtrack’s “All the Stars” with SZA jumped by 290 percent, and “Man at the Garden” from GNX increased 260 percent in streams.

Lamar’s “Euphoria” jumped by 260 percent, “Squabble Up” went up by 230 percent, and “Peekaboo” featuring Azchike went up by 230 percent. Spotify described Lamar’s streaming increases as “The Halftime Effect,” which also trickled its way to SZA’s streaming numbers. The R&B star, who joined Lamar for “All the Stars” and “Luther” during the halftime set, saw her own music go up by 80 percent in the United States.

“Thank you for lifting me up. Thank you for encouraging me and being so willing to bend to whatever I may need,” SZA wrote to Lamar on Instagram after the performance. “You’re a prophet. But you knew that. I wasn’t nervous today. I was ready to rep for u. For US.”

[From Rolling Stone]

I’m really glad that so many people are curious about Kendrick or they liked what they heard and wanted to hear more. This was seen by many as the final nail in Drake’s coffin – Kendrick has been dog-walking Drake since April and May of last year. Kendrick really stood on THAT stage, looked into the camera with that magnificent smile and said “Say Drake, I hear you like ‘em young.”

Additionally, there are a lot of white music critics with a lot of thoughts about Kendrick’s Halftime performance and how it was “bad” or “not enough” or whatever. I wonder if people genuinely thought it was going to be like The Pop Out? That man performed on FOX at the Super Bowl, he’s not going to perform “Not Like Us” uncensored six times, you know? I also think the OVHoes are trying desperately to pour scorn all over this.

Kendrick Lamar’s Super Bowl Halftime performance was incredible & hilarious

People are really, really happy for the Philadelphia Eagles for not just winning the Super Bowl, but thoroughly dog-walking the Kansas City Chiefs. Lots of people were Eagles fans for one day, just for the SB. But the Eagles weren’t the only massive success story! Kendrick Lamar performed his much-anticipated Halftime Show and he killed it. It was so good! His artistry goes beyond lyricism – I was in awe of the staging, the way he used the dancers clad in red, white and blue, bringing in Samuel L. Jackson for to play “Uncle Sam” to facilitate the transitions. A lot of time and thought was put into this, and Kendrick said in his Apple Music interview last week that he had his pgLang team in New Orleans helping him and organizing everything. Here’s the performance, which included GNX, Squabble Up, Humble, DNA, Not Like Us, Euphoria, Man at the Garden, Peekaboo, Luther, All the Stars and TV Off. SZA did two songs with him and Mustard made an appearance.

The one thing is that Kendrick didn’t actually call Drake a PDFile – it wasn’t even the Fox censors blocking it for broadcast, Kendrick just didn’t say the word whatsoever. But you know what? He didn’t need to. The way the opening bars of “Not Like Us” were played a few times, like an anticipatory threat, was brilliant, as was “I want to perform their favorite song, but you know they love to sue.” Plus, Kendrick definitely had the whole stadium singing along to “A MINNNNNORRR.” He was even wearing a lowercase “a” diamond necklace too. Just to rub it in. Then at the end of Kdot’s performance, the “Game Over” lights – *chef’s kiss*. I’m going to talk about Serena Williams in a stand-alone post!

Also: Kendrick’s smile when he got to say “SAY DRAKE” at the Super Bowl. Truly the best moment.

Kendrick Lamar wore a Canadian tuxedo as he picked up five Grammys for ‘Not Like Us’

Embed from Getty Images

Before the Grammys broadcast even started, Kendrick Lamar was picking up Grammy Awards. He wasn’t even in the audience at that point, so DJ Mustard accepted the Grammys for Best Rap Song, Best Rap Performance and Best Music Video. Kendrick was there to accept Song of the Year and Record of the Year. Keep in mind, ALL of these Grammys were for “Not Like Us,” arguably the most significant diss song of all time. Kendrick released his album, GNX, past this year’s Grammy cut-off date, so the Grammy Awards just decided to give him five awards for calling Drake a PDFile.

The best part was when Kendrick accepted the Grammy for ROTY for “Not Like Us.” That man wore a CANADIAN Tuxedo, all denim. The entire audience stood and cheered for him and several huge stars could be seen rapping along and/or dancing as “Not Like Us” played. That’s got to hurt for Drake – the entire Grammy audience singing along to “A Minnnnnor.” Kendrick also dedicated his ROTY to Los Angeles, and he shouted out neighorhoods and areas affected by the Southern California wildfires. He also showed a lot of respect to Diana Ross for SOTY. Next Sunday, he’s got the Super Bowl Halftime show!

Drake sued UMG for defamation over Kendrick Lamar’s beef-winning diss songs

As we discussed this week, Drake decided to withdraw his legal petitions against UMG (Universal Music Group) and Spotify. He sent the notices last fall, basically accusing UMG and Spotify of artificially inflating Kendrick Lamar’s numbers for Kendrick’s diss songs against Drake in the spring of 2024. Drake’s argument was convoluted – he basically argued that UMG and Spotify “helped” Kendrick game the system, and “Not Like Us” wouldn’t have been an organic song of the year on its own, it needed UMG and Spotify to push the song down people’s throats. Which wasn’t the way it actually went down, at all. In any case, Drake and Spotify walked away from that, but UMG was basically like… let’s see what this dumbass does next. They didn’t have to wait very long – Drake has now sued UMG for defamation for ALLOWING Kendrick to talk sh-t in “Not Like Us.”

Drake is not backing down in the war against his own label, in fact he’s now upped the ante by suing Universal Music Group for spreading the “false and malicious narrative” he’s a pedophile … TMZ Hip Hop has learned.

Drake filed the defamation case Wednesday morning in federal court in NYC … ripping UMG for releasing and promoting Kendrick Lamar’s vicious diss track, “Not Like Us.” In the docs, obtained by TMZ Hip Hop, Drake says UMG knew full well Kendrick’s lyrics, and images in the music video, referring to Drake as a pedophile were false and dangerous. In the suit he calls Kendrick’s hit — filled with “inflammatory and shocking allegations”– was a “gold mine” for UMG … and he says they had an ulterior financial motive in promoting it.

Drake claims his label was doing everything it could to pump up “Not Like Us” because it knew it would devalue his music and brand … and, therefore, give UMG leverage in future contract negotiations with Drake. Keep in mind, Drake’s last UMG contract, signed in 2022, was a blockbuster deal worth a reported $400 million!

Drake says he’s got bot receipts to show just how far the label went to turn Kendrick’s song into an anthem. According to the suit, UMG paid a third party to use bots to increase the song’s streams by at least 30 million — and engaged in a “pay for play” scheme with at least one radio promoter. He claims UMG attached the label “chart-topper” to “Not Like Us,” despite knowing that title was based on fraudulent data.

It’s also clear Drake’s very mindful of what’s going down in New Orleans next month — in the suit, he claims UMG was in on getting Kendrick the Super Bowl Halftime gig … so, the song could be performed on that massive stage, which he calls “one of the most significant (and viewed) cultural events of the year.” Ya gotta wonder — will the NFL and FOX, which is airing the Super Bowl, allow Kendrick to use the pedophile lyrics when he performs??

Interestingly, Drake isn’t going directly after Kendrick in the suit — in fact, he says, “This lawsuit is not about the artist who created ‘Not Like Us.’ It is, instead, entirely about UMG, the music company that decided to publish, promote, exploit, and monetize” the song which it knew contained false claims.

A spokesperson for Universal Music Group tells TMZ … “Not only are these claims untrue, but the notion that we would seek to harm the reputation of any artist — let alone Drake — is illogical. We have invested massively in his music and our employees around the world have worked tirelessly for many years to help him achieve historic commercial and personal financial success. Throughout his career, Drake has intentionally and successfully used UMG to distribute his music and poetry to engage in conventionally outrageous back-and-forth ‘rap battles’ to express his feelings about other artists. He now seeks to weaponize the legal process to silence an artist’s creative expression and to seek damages from UMG for distributing that artist’s music.

“We have not and do not engage in defamation — against any individual. At the same time, we will vigorously defend this litigation to protect our people and our reputation, as well as any artist who might directly or indirectly become a frivolous litigation target for having done nothing more that write a song.”

[From TMZ]

If I’m being honest, I think there’s a small sliver of truth to the idea that UMG wasn’t mad that Drake was being taken down a few pegs because that meant Drake couldn’t negotiate another hugely lucrative deal. But that’s the only part of Drake’s lawsuit which has any grounding in reality – the rest of it is Drake’s delusional cope. This is one of the most important parts of UMG’s response: “Drake has intentionally and successfully used UMG to distribute his music and poetry to engage in conventionally outrageous back-and-forth ‘rap battles’… He now seeks to weaponize the legal process to silence an artist’s creative expression and to seek damages from UMG for distributing that artist’s music.” That’s it in a nutshell – Drake wants to play victim and act like UMG should have been judicious in how they disseminated Kendrick’s songs, and yet UMG did the right thing by simply letting the beef play out without censoring anyone.

As for defamation… Drake said that Kendrick’s partner Whitney was cheating on him and that Kendrick’s son Enoch wasn’t biologically his. Drake said that Kendrick physically abused Whitney. Drake also said that Kendrick was molested. All of those lyrics were lies, and UMG “allowed” Drake to release that music too. Kendrick hasn’t gone around, suing people over it. Kendrick just churned out some of the best disses ever in response to Drake’s lies.

There’s so much stuff in Drake’s lawsuit, but something which is getting a lot of attention is that he name-checked a lot of YouTube reactor channels. Before last year, I never watched music reactors, but I got into several YouTubers because of the Drake-Kendrick beef. Those people are just doing it because they love the music, the gossip and the drama. They weren’t being PAID to promote Kendrick. Most of those people were Drake fans! I wanted to post No Life Shaq’s reaction to being name-checked in Drake’s lawsuit because I was laughing my ass off, especially when he brought his son out to call Drake a snitch. NSFW for language. Everything he says here is the truth. I think I’ll also include a reaction compilation for “Not Like Us.”
