Child support Custody battles Elon Musk Grimes

Grimes sues Elon Musk over parental rights to their three children

We really don’t know much about the Elon Musk/Grimes situation other than they have three kids together and that two were born via surrogacy. Their second child, a daughter nicknamed Y, was born around the same time that Neurolink exec Shivon Zilis gave birth to another set of Elno’s (not a typo!) twins. From what we can gather via social media, the first time Grimes (government name: Claire Boucher) saw Zilis’ twins was when biographer Walter Isaacson shared pictures of them. This prompted her to post publicly, “Tell Shivon to unblock me and tell Elon to let me see my son or plz respond to my lawyer. I have never even been allowed to see a photo of these children until this moment, despite the situation utterly ripping my family apart.”

YIKES. Eventually, Grimes and Zilis had some girl talk over the phone and decided to let their kids grow up together. You’d think all was well in paradise, no? Well, apparently not! It looks like the Elon Musk/Grimes stuff may get messier. In light of Grimes’ allegations that she wasn’t allowed to see at least one of her children with Space Karen, she filed a “petition to establish parental relationship” against him in a California court last week.

Elon Musk is being sued by ex Grimes over parental rights of their three children.

Grimes filed a “petition to establish parental relationship” on Sept. 29 in a California court, according to court records obtained by Page Six on Tuesday.

The request asks the court to identify the legal parents of a child when they are not married.

The billionaire, 52, and “Oblivion” singer, 35, are parents of three children. Their first son, X Æ A-Xii, arrived in May 2020. In December 2021, they quietly welcomed daughter Exa Dark Sideræl via surrogate.

It was only confirmed in September that the pair secretly had a third child, a boy named Techno Mechanicus, whom they call Tau. The news was revealed in journalist Walter Isaacson’s “Elon Musk” biography.

[From NY Post]

I did a little bit of research and learned that a “petition to establish parental relationship” is a common legal procedure for couples who are not married. It’s a first step in deciding important issues such as custodial rights and child support. (Family lawyers or paralegals, feel free to weigh in here.) The court filings are private, so we don’t know all of the details, but I’m guessing that Grimes is currently still in her “I’ve had enough of Elon’s bulls–t” phase and wants to set up formal custody and child support arrangements to make sure she has a legal right to see her children. I think this is where it’s going to start to get really interesting, especially if Apartheid Clyde continues to play games with letting Grimes see their kids. Disclosure in a custody and (especially) a child support battle could reveal a lot more than either party want us to know.

For my fellow Star Wars nerds out there:

Is it just me or does Thrawn look like a blue Elon Musk?

That’s all I can see when this guy is on screen. A blue Elon. pic.twitter.com/3mOdPvmeT1

Custody battles Joe Jonas Sophie Turner

Sophie Turner & Joe Jonas agree to not remove their kids from New York for now

Sophie Turner arrived in New York two weekends ago, after spending months in the UK, filming an ITV miniseries. Her work schedule was “the reason” why she agreed to Joe Jonas’ scheme to bring their daughters back to America, so the kids would be with him on tour. When she arrived in NYC, Joe had already filed for divorce and gotten the Florida court to serve Sophie with an order saying that she couldn’t take their daughters back to England. Last Thursday, Sophie filed her own lawsuit against Joe, telling the court that Joe was holding their daughters’ passports and that her daughters need to be with her, at home in England.

When Joe responded to Sophie’s lawsuit, he noted that he dropped their girls off with her in New York two Sundays ago, so she had the kids all last week. Jo’s team had also spent more than a week smearing Sophie as a “partier” who liked to do unsavory things like “work” and “hang out with friends” and “drink.” Hours after she filed her lawsuit, Sophie went out with Taylor Swift for the second night in a 72-hour period – both nights they went out, they went to dinner and then they changed locations to hit up a trendy bar. The photos played into Joe’s narrative. Apparently, someone got through to Sophie that the optics were pretty bad because on Friday night, she skipped the bar-hopping and went straight to Taylor Swift’s penthouse apartment, according to Page Six. No photos, which is good. It also looks like Sophie will probably be spending more time with Swift, because Sophie and Joe have signed onto some kind of temporary agreement to keep their daughters in New York for now.

Joe Jonas and Sophie Turner have agreed they will NOT take their kids outside the greater New York City area for now … this, just days after Sophie filed legal docs saying her intention was taking the kids to the UK for good. Both Joe and Sophie agreed to a temporary consent agreement and filed it with a federal judge. Daily Mail first reported the filing.

As we reported, Joe and Sophie are locked in a legal battle over custody. Sophie went to federal court last week, citing a child abduction law and claiming Joe refused to turn over the passports of their 2 kids. She claimed they had an agreement the kids would live in the UK.

Joe countered, saying a judge in Florida — where he filed the divorce — said the kids could not be removed from the U.S., thus setting up a legal battle. The agreement they made is not binding on a U.S. judge. The North Star in determining custody is what is in the best interests of the children.

[From TMZ]

I’m glad that they at least came to some kind of limited, temporary agreement. As part of Sophie’s lawsuit, she listed all of her temporary residences this year, following the sale of the Turner-Jonas home in Miami. It does seem like Joe and Sophie don’t OWN property in America at this point? I wondered if they still had that condo in New York, but they apparently listed it in 2020. So… is Sophie staying at a hotel? Some kind of rental or Airbnb? Hm.

Cheryl Burke Custody battles Dogs Matthew Lawrence Pets

Cheryl Burke awarded custody of dog in court case with Matthew Lawrence

Cheryl Burke’s divorce from Matthew Lawrence has seemed somewhat contentious based on the information about it she’s putting out there herself. She strongly implied that he cheated and she took him to court over custody of their dog. The dog custody issue persisted after their actual divorce was finalized, but now it’s resolved — Cheryl gets custody of Ysabella.

Cheryl Burke and Matthew Lawrence have reached a settlement in their pet custody dispute.

According to court documents, obtained by Us Weekly on Saturday, January 14, the Dancing With the Stars alum, 38, was awarded all ownership rights pertaining to French bulldog Ysabella. Per the court filing, Lawrence, 42, has agreed to give up any documentation or data pertaining to the pup.

While Burke and the Boy Meets World alum settled their divorce late last year, they remained at odds over who would care for their Frenchie.

“I am now officially divorced. This all happened on premiere night of Dancing With the Stars,” the Dance Moms alum said during an October 2022 episode of her “Burke in the Game” podcast. “But it is still not over because we have to go to trial — unless he all of a sudden calls it off — but that will happen in January.”

She added at the time: “I am still really hurt by the whole situation because that is my dog. Ysabella is my daughter; I am a dog mom. I couldn’t even imagine my life without her. I could just cry right now.”

Lawrence, who was married to the choreographer for three years, had previously gifted Ysabella to his then-bride following their May 2019 nuptials. Throughout their relationship and divorce proceedings, Burke took charge of taking care for the pooch.

“I have to give credit to my dog Ysabella for keeping me going a lot of the time,” the two-time DWTS champ wrote in an exclusive essay for Us Weekly last October. “Yep, I’m a full-blown ‘dog mom’ and not ashamed to say it! Going through a public divorce, there have been days where I wanted to just stay in bed and hide, and the idea of numbing my emotions with a vodka soda can sound pretty appealing. But Ysabella has tons of energy and gets me outside to go for walks multiple times a day, she loves me to play with her and I honestly can’t imagine life without her by my side 24/7.”

[From US Weekly]

I’m no expert in pet custody, but if Matthew gave Cheryl the pup as a gift, it would seem she’s the rightful owner/mom, but I think documents may have played a factor as well. Something similar happened to my friend during a breakup — she went to court with her ex because she wanted the dog, but despite the fact that she was more attached and had done all the caring, the dog ultimately went to her ex because his name was on all the papers. It sounds like Cheryl was the appropriate person for the dog — the dog was a gift to her and she did all the caring. I’m sure Matthew loved the dog as well — obviously, if they went to court — but she was Cheryl’s dog. I definitely empathize with Cheryl in this situation. Regardless of the circumstances under which we parted, I couldn’t imagine an ex ever trying to take my beloved pet and especially not after a contentious breakup. It sounds like the dog is bringing Cheryl a lot of peace at this time and that’s great.

Custody battles Jesse Williams

Jesse Williams granted visitation with his LA-based children in New York

Last we talked about Jesse Williams, he’d asked for an emergency hearing about his children’s visitation schedule while he is performing on Broadway. His ex-wife, Aryn Drake-Lee, had taken issue with the schedule of flying the two elementary school-aged children across the country during the school year for what essentially amounts to a weekend visit. As I wrote at the time, flying across the country for just a four-day trip is A LOT for an adult, much less a child. However, the court doesn’t agree and has overruled Aryn’s request, awarding visitation to Jesse in New York, I guess, designed to accommodate his schedule.

Jesse Williams has been granted various visitation days with his kids in New York City, overruling ex-wife Aryn Drake-Lee’s previous request to keep their children in Los Angeles.

The Grey’s Anatomy star and the real estate agent, both 41, were together for over 10 years and married for five before he filed for divorce in April 2017. The two share daughter Sadie, 8, and son Maceo, 7.

According to new court documents obtained by PEOPLE, Williams and Drake-Lee appeared in court on Sept. 30 where the actor was awarded his requested custodial visits with his children while he temporarily moves to N.Y.C. from Los Angeles this fall to reprise his Tony-nominated role in the Broadway revival of Take Me Out. (A previous court order granted Williams custody during his spring run in the play that allowed him four consecutive days a month in N.Y. with his children.)

While Drake-Lee previously argued against Williams’ visitation in N.Y., the court awarded that their two kids can visit the actor in N.Y. on specific days in October, November and December.

The court also ordered 10 sessions of co-parenting counseling for Williams and Drake-Lee.

The order also stated that “each party is restrained from making derogatory remarks about the other party, either directly or indirectly to the minor children, nor allow any third party to do so.”

In addition, the judge ordered that Williams and Drake-Lee are not to “discuss this case with or in front of the minor children nor allow anyone else to do so” or use their children as “a messenger to deliver messages to the other parent.”

“The parties shall not ask excessive questions or interrogate the children about what happened while when in the other parents’ custody,” the order stated.

The judge also ordered that neither Williams or Drake-Lee may “post derogatory remarks about the other party that the minor children can see in social media.”

Following the hearing, Drake-Lee appeared to make her feelings about the matter public, sharing an Instagram post about long-distance visitation.

“It turns out the court does think it’s good for children to regularly fly on overnight flights to accommodate a parent who won’t do the same for them,” she wrote. “Who knew? I knew…Those of us who walk this path know what it is and know what we need to do to protect ourselves and our babes to the best of our ability.”

“Every day we show up and do what’s needed despite the circumstances. I know I journey this road with my head held high and my integrity in tact. Let’s see how long it takes for the usual suspects to leak targeted language and storylines painting a particular party as the victim,” she added.

[From People]

I guess it’s good that the court has also ordered that the former couple attend co-parent counseling and can’t make derogatory remarks about each other on social media. Aryn has continued to post, but nothing about it has been derogatory. In fact, everything she’s written has been fairly neutral and rather restrained. Whereas Jesse has behaved shadily from start to finish, but while hiding behind his team and TMZ and his pretty eyes. I was honestly surprised about the sympathy for him. Normal people stay in jobs to support their families and the idea that the children should suddenly make do with much less so he could pursue ~art~ was mind-boggling to me. Perhaps the sheer numbers were influencing opinions, so instead imagine suddenly dropping from $4,000/month to $750. That’s a dramatic decline/change in lifestyle. And I guess Aryn understands that a lot of people are giving her Kim K’s “get your f-ing ass up and work” attitude so she posted a history of her support of Jesse and their family before his career took off. When they met, she was the more established one and poured years of money and effort into him. Hopefully, Jesse eventually comes to his senses and appropriately supports his children instead of viewing it as paying his ex-wife, but it seems like he won’t and the courts and men’s rights’ media like TMZ are helping him get away with it.

Custody battles Divorces Jesse Williams

Jesse Williams’ ex-wife Aryn Drake-Lee: I have stayed quiet far too long

Embed from Getty Images

Jesse Williams and Aryn Drake-Lee’s divorce and custody drama has been dragging on since 2017. Wow, it was like a completely different world back then. Jesse has been making headlines for, ah, other things, lately, but the settlement stuff has quietly been simmering behind the scenes this whole time. They reached a custody and support settlement in 2019, but Jesse last year petitioned for a support reduction due to his changed income after willingly leaving the comfort of network TV for Broadway. (Though he was in an episode of Grey’s last season and is scheduled to be in at least one this season according to IMDB and Sarah Drew).

Now Jesse’s asked for an emergency hearing over custody due to his upcoming second run of Take Me Out in New York, while Aryn and the children are based in LA. He says she’s violating the court order and causing emotional damage; she posted on Instagram that she’s going to be silent no more and has receipts.

As RadarOnline.com first reported, this week, Jesse asked for an emergency hearing after Aryn refused to agree to let their two children fly out to New York to see him while he performs on Broadway in the hit Take Me Out.

Jesse said Aryn would not agree which led to him running to court. He explained, “I recently agreed to perform in the second run of Take Me Out starting in October 2022 and ending in January 2023. The play is set to start in October 2022 and run through at least January 2023. I am returning to New York in early October to start rehearsals. I asked Aryn to honor the Court’s prior order so I can continue to spend quality time with our children while I am in New York. Aryn refused.”

The actor claimed Aryn’s violations of the court order had caused both him and their children emotional damage.

Hours after RadarOnline.com broke the story, Aryn posted a photo of herself on the beach. She didn’t hold back writing, “Is it good for the health and wellness of a 7yr and 8yr old to be taken out of school on a regular basis to fly cross country overnight on a red eye to be on the ground for two days? Is it reasonable for them to return dazed and confused and then be expected to pick right up and survive at school the rest of the week?”

She continued, “I don’t think so! Neither do any of the parents who actually parent on a routine basis. There’s a name for the condition of an adult who expects their children to indulge, caregive and service that adult’s desires at the childrens’ expense…”

She included the hashtags “I have stayed quiet for far too long” and “receipts seasons.”

The couple — who were together for 13 years – were married from 2012 through 2017. The split was incredibly bitter with both sides accusing the other of playing dirty.

The couple reached a settlement in 2019 where Jesse agreed to pay $40k a month in child support. However, last year, Jesse went back to the court pleading for the amount to be reduced. He said the amount was based on his income when he starred in Grey’s — when he was pulling in over $6 million per year.

Jesse said his income had dropped drastically since he left the show. He pointed to his Take Me Out weekly paycheck of only $1,600.

Aryn said Jesse was selfish for leaving Grey’s and only looked out for his own best interest. She said his child support payments should not be axed. However, a judge recently sided with the actor and cut the payments down to $7k.

[From RadarOnline]

Jesse will be performing in New York from October through January. And he wants the kids to come out for four days each month; he wants to see his children. But the position Aryn shared in her Instagram post makes perfect sense: flying across the country for just a four-day trip is A LOT. It’s a lot for adults (I can’t do it unless forced to for work) and it’s certainly a lot for children that young. It’s a lot even before factoring in that the kids are expected to attend school on the other side of these trips. Surely there is a compromise to be made, perhaps over the Thanksgiving and winter holiday breaks that are longer than a weekend?

But even giving Jesse the benefit of doubt — that he just wants to see his kids — it’s hard to take his side after he left Grey’s Anatomy of his own accord and now the child support is reduced to less than 25% of what it was before. I can understand wanting to leave your job, but dude you have kids to provide for. Step it up. I’m sure that’s why Kevin McKidd is still on the show. Aryn’s post sounds like she’s reached the end of her rope and she’s alluding to a lot more than we’ve heard when she says Jesse expects things at his convenience, at the children’s expense. I want to like him because of his activism and he was on Grey’s and all that, but he pulls this crap and makes it impossible.

Custody battles Jason Sudeikis olivia wilde

Jason Sudeikis & Olivia Wilde’s custodial fight has gotten extremely messy

In late April, Olivia Wilde attended Cinema Con in Las Vegas, which is an industry event where directors and actors hype their films to theater-owners and studios. Wilde was there to give a presentation for Don’t Worry Darling, which she directed. While she was on stage, a woman stood up from the audience and handed her an envelope. Olivia accepted the envelope, not realizing what it was. As it turned out, the woman was a process server and Olivia was served with legal papers related to custody and residency of her two children. Jason Sudeikis’s lawyer had hired the process server, although no one was quite sure if Jason made the call to have Olivia served on stage. We also weren’t sure if Olivia knew that Jason was trying to serve her with a legal filing. Now, months later, the Daily Mail ran an exclusive look at the fallout after Olivia was served. Jason and Olivia’s split has gotten very spicy.

Olivia Wilde has accused ex Jason Sudeikis of intentionally trying to ’embarrass’ and ‘threaten’ her when she was awkwardly served with custody papers on stage at a live event in April. The actors had continued to co-parent and share custody of their kids since their 2020 split, alternating one-week periods of ‘parental access’, while they both split their time between New York, Los Angeles, and London. But those arrangements became no longer viable in April this year, when the pair had a disagreement about where they would be raising their children permanently, prompting Sudeikis to file a custody petition.

In her motion to dismiss the action, Wilde said the two had initially agreed to send their kids back to school in Los Angeles for the upcoming school year since Sudeikis was due to wrap up the final season of Apple TV series Ted Lasso which had required him to be in London.

‘Recently, however, Jason decided that he wanted to go to New York for the next year while he is not working, and wanted the children to be with him there during this time off,’ the actress said in the filing. ‘When I did not agree, since the children have not lived in New York for several years, Jason filed these papers.’ Wilde, who began dating Styles in January 2021, argued that the children have spent most of the last four years in LA or in London, even attending schools in the two cities.

Wilde referenced the embarrassing [Cinema Con process server] incident for the first time in her court motion, slamming her ex for his ‘outrageous legal tactics’ and delivering the documents ‘mid-speech.’ ‘Jason’s actions were clearly intended to threaten me and catch me off guard. He could have served me discreetly, but instead he chose to serve me in the most aggressive manner possible,’ she said in the documents. ‘The fact that Jason would embarrass me professionally and put our personal conflict on public display in this manner is extremely contrary to our children’s best interests. Since Jason has made it clear that we will not be able to work this out for our children’s sake outside of the court system, I filed a petition for custody in Los Angeles.’

[From The Daily Mail]

“Jason’s actions were clearly intended to threaten me and catch me off guard”…? Catch her off guard, yes. Embarrass her, yes, indeed. But threaten her? I don’t know. As for the custodial and residency issue, Sudeikis has traveled a lot in recent years, spending months at a time in the UK, filming Ted Lasso. After being New York-based with Jason for years, Olivia moved back to LA in 2020 and she seems happy there, with space for the kids to run around and a private yard and a pool. I honestly don’t completely blame her for saying “I’m going to live in LA, you can visit.” As for Jason’s declaration, well, it’s full of interesting stuff too:

In his declaration to the court, Sudeikis said that while he, Wilde, and their two kids had been living in London since December 2021, he intended to return to his ‘permanent home’ in Brooklyn when filming for Ted Lasso concluded in July. He said he hoped that his ex and their children would also return to New York so they could continue their current custody arrangement. Sudeikis said he now believes those plans are ‘unlikely to occur’ after Wilde ‘insisted upon’ living with their kids in LA and asked him to join them during a discussion over custody in April. She also disclosed her future plans to move to London, where she has been living with former One Direction star Harry Styles, 28, at the end of next year.

‘For better or worse, I am a New Yorker,’ Sudeikis said, adding that it was in the kids’ best interests to grow up in Brooklyn. He also claimed he had been ‘reluctant’ to serve Wilde because he continues ‘to care deeply for her’, but said he was spooked by two particular statements during their conversation. ‘First, Olivia said that if I did not reside full-time in Los Angeles, she would allow me to spend time with Otis and Daisy on weekends and during vacation periods – thus depriving me of my right to parent the children during important periods of their lives…,’ Sudeikis said. He continued: ‘Second, Olivia said that she intended to relocate with the children to London following the close of school in 2023.’

Sudeikis, ‘fearful’ that she would ‘take Otis and Daisy’ from him, said he then asked his attorney in that moment to serve the summons and petition to Wilde knowing shew was scheduled to travel to LA the next morning. The actor claimed he had always hoped she would be served in a ‘benign manner’ and requested service take place at Heathrow Airport, rather than boyfriend Harry Styles’s home, where she is currently living.

‘I did not want service to take place at the home of Olivia’s current partner because Otis and Daisy might be present. I did not want service to take place at the children’s school because parents might be present,’ Sudeikis said.

The actor goes on to say that the process server was ultimately unable to serve Wilde at the intended location that day due to a series of logistical mishaps. He said he would only learn Wilde would be ultimately served in public days later when the incident made headlines. Sudeikis claimed he was ‘deeply upset’ at the turn of events and later found out that Wilde’s whereabouts were tracked down thanks to a tweet speculating her appearance at CinemaCon.

An attempt was made to serve Wilde at her hotel in Las Vegas where the event was held, but after that failed, the server ‘noticed Olivia at the Warner Brothers Panel and proceeded to serve the Summons and Petition upon Olivia.’

Sudeikis said he continues to ‘feel great distress at the manner in which service was made. I understand that the process server had only done her job; however, I deeply regret what happened. Olivia’s talk was an important event for Olivia, both professionally and personally, and I am very, very sorry that the incident marred her special moment,’ he added.

[From The Daily Mail]

Yeah, I buy that “serving Olivia at Cinema Con” wasn’t Jason’s call and he didn’t like the way it went down. I just don’t think a client would dictate to their lawyer or to a process server “see if you can serve her the paperwork while she’s on stage at a big industry event.” That’s insane. And Olivia’s making plans to move to London full-time with Harry Styles? And take the kids there next year? Well…I understand why Jason isn’t happy. This is a really messy custodial dispute.

Oh, and this narrow part of the custody issue is over – these declarations were about which family court had the jurisdiction. Sudeikis filed in New York, and the New York court said no, the kids are not New Yorkers, this should go to an LA County family court.

Denise Richards blindsided by ruling that Charlie Sheen doesn’t have to pay support

Denise_Richards

Denise Richards is not having a fun fall. Last month, her oldest daughter, Sami, blamed her mother for a restrictive household and went to live with her father, Charlie Sheen. Last Monday, a judge said Charlie no longer had to pay Denise any child support. The problem is, their other daughter, Lola, 16, still lives with Denise. According to Denise’s side, Charlie has been moving this court date around for two years and sprung this latest one on Denise while she was out of town filming. Charlie’s side said Denise has been aware of it for six months.

Charlie Sheen no longer has to pay ex-wife Denise Richards child support, a court ruling that caught the actress off guard, a source says.

A judge made the decision in Los Angeles County court Monday, adjusting the child support payment to “zero dollars per month” commencing from August 1, 2018, according to documents obtained by PEOPLE.

Sheen, 56, shares daughters Sami, 17, and Lola, 16, with Richards, 50.

Richards was not in attendance during the court proceedings. (On Instagram Friday, she wrote that she was traveling for work, explaining that “it’s hard being away from home and my family.”)

A source close to Richards told PEOPLE she was “blindsided” by the court date and ruling.

“Charlie filed two years ago and kept pushing the court date, so Denise was very surprised that it happened yesterday while she is out of town filming. She was blindsided,” the source said, further alleging, “Now he’s manipulating the situation.”

“Lola does not live with Charlie. She lives with both of her parents and stays with Charlie when Denise is out of town. When Denise is back, Lola will be with her,” the source clarified. “This is very disappointing for Denise, but also not surprising. Charlie is pitting the girls against their mother, which is horrible.”

An insider close to the situation, however, tells PEOPLE that Richards “has known about the court date for six months.”

[From People via Yahoo!]

The People article rehashes the fallout with Sami quite a bit. They included a new detail about Denise installing cameras to monitor Sami sneaking out at night. However, I don’t think those issues factor into a child support decision. Living arrangements would, though, and salaries. My assumption is that Denise is making more money than Charlie now. If Sami is living with her dad full time and Denise is earning equal or more than Charlie, then I can see why the child support was changed. I’m shocked it got adjusted to zero, though. Even if Denise wasn’t there in person, her lawyer should have been. Once again, there’s a lot of information missing from the story.

Legally, there are reasons this could have happened. However, this is Charlie Sheen we’re talking about and Denise is not as squeaky clean as we thought either. Her new husband certainly isn’t. A few things concern me. First, even though salary and Sami’s move would factor into the decision, Charlie filed this two years ago. Neither of those things were applicable back then. Second, why are Lola’s living arrangements being discounted? The friend said Charlie was “pitting the girls against their mother.” Is he taking Lola away too? I know Charlie has done a lot of work on himself, but he has lashed out at Denise and the kids in the past. Did Denise know about the court date? If he sprung this on her while she was out of town and both girls where physically under his roof, that sounds nefarious. But pop-up court dates are hard to come by in Covid times. Who knows.
