Amber Heard & Johnny Depp’s restraining order hearing has been postponed

I was being completely selfish about Johnny Depp and Amber Heard’s scheduled restraining order hearing. All I kept thinking was, “Is every entertainment journalist and gossip blogger going to have to hang around for hours on a Friday afternoon and evening to learn the details about the hearing?” But it looks like the much-anticipated hearing has been postponed. And Amber Heard wants you to know that it wasn’t her call. The postponement came after a conference call between Depp’s lawyer, Laura Wasser, Amber’s lawyer and the judge. Wasser asked for the continuance and Wasser also wanted the judge to give both sides to talk about a settlement. Johnny Depp and Amber Heard’s hearing on domestic violence claims has been pushed to August, and a temporary restraining order against the actor has been reissued, PEOPLE has confirmed. The former couple were set to face off in a Los Angeles courtroom to address Heard’s domestic violence restraining order request. The hearing “was advanced and vacated,” the L.A. County Superior Court said in a statement after a phone conference involving Depp and Heard’s lawyers. The official hearing on Heard’s permanent restraining order request has been rescheduled for Aug. 15 and 16, but a status conference has been set for Aug. 2. Heard and Depp are not required to attended the status conference. A source tells PEOPLE that Depp’s attorney Laura Wasser asked for a continuance to postpone the hearing. [From People] It doesn’t surprise me that the hearing has been postponed, although it would surprise me if Amber and her lawyers were seriously considering a settlement. Just my opinion: Amber has Depp by the short hairs and she could probably run the table for a possible settlement, but everything seems to indicate that she wants her day in court. Will Amber hold out until August? It could go either way, depending on Depp’s ability to agree to Amber’s terms, I would guess. In the lead-up to the postponement, Amber and Johnny’s teams were sniping at each other in the press too. TMZ reported earlier Thursday afternoon that Depp wanted the postponement and he was willing to come to the table and negotiate a settlement for everything, including spousal support. Amber’s team then leaked stories about how she would never settle and that Depp is “terrified about what she’ll say on the stand.” There was also some question about why Amber was in LA this week when she had told everybody that she would be in London for costume fittings. According to TMZ, she returned to LA early because the Aquaman/Justice League costumers thought she was too skinny for a fitting. Apparently, she’s lost 20 pounds in the past few months just from the stress. Amber Heard withdrew her request for temporary spousal support

Johnny Depp has been “recuperating on his private island” for about a week now. The Hollywood Vampires’ European tour was over last week, and Depp flew to the private island he bought, years ago, for himself and his family. A source told People Magazine that: “Johnny is doing okay. He likes retreating to his private island whenever he can. He hasn’t been there for a while, and really seems happy being there now… He wants to see his kids, but otherwise he isn’t looking forward to returning [to L.A.]. He doesn’t seem too worried about court though. He has an excellent lawyer who is taking care of things.” [From People] Yeah, I’m so glad we got this important update on how HE feels. People Mag also says that Depp is due back in LA tomorrow, Wednesday, in time for Friday’s restraining order hearing and court appearance. So, we’ve established that Depp is away from LA… so why were his friends removing a bunch of stuff from the apartment Depp once shared with Amber? Yesterday afternoon/evening, Depp’s people began removing items from the LA apartment and Amber Heard’s people called the police. While Depp had permission, from the temporary restraining order, to have some of his items removed, there is some question whether these items fall into that description. Amber Heard’s camp just called the police … claiming Johnny Depp’s people are taking items from his downtown L.A. home in violation of the restraining order she has against him. Law enforcement sources tell TMZ … LAPD officers are responding to a possible violation of a court order. Johnny was ordered to stay 100 yards away from his home with Amber when she got the temporary restraining order. Sources connected to the former couple tell us Johnny himself is not there, but his people are removing things from the walls and taking furniture out of the home. Part of the restraining order includes a “move-out order” … which allows Depp to take personal clothing and belongings needed until Friday’s hearing. Amber’s camp believes his people are overreaching, especially because Johnny is in the Bahamas right now. The insinuation is clear … why the urgency? Sources close to Depp confirm his team is taking “personal items” and they believe it’s within the scope of what the order allows. [From TMZ] Amber was apparently not home either – she’s probably in London, or en route to London right now for her Aquaman/Justice League fittings. Apparently, Depp’s people really were trying to take furniture and bigger items from the apartment but the police officers made them put everything back? And finally, Amber’s lawyers have just filed new paperwork withdrawing Amber’s request for temporary spousal support. Amber doesn’t want to deal with the money side of things at Friday’s hearing, she just wants to deal with the restraining order alone, and deal with spousal support at a later date, probably through the divorce settlement negotiations. Sources tell TMZ that Amber only requested spousal support because she “thought it was standard operating procedure in a divorce case, but now feels Depp’s team is twisting it in the media. In the docs, she says it’s being ‘used against me to distract and divert the public away from the very serious real issue of domestic violence.’” That’s a really smart move, I think. Johnny Depp’s ex-assistant claims Amber Heard is lying about the 2014 texts

One of the most frustrating things about the Amber Heard-Johnny Depp situation is not just the bro-culture of Johnny’s fans, but the blatantly misogynistic tone of some/much of the reporting. The way Amber’s story has been second-guessed and third-guessed and fourth-guessed by TMZ and other outlets has gotten ridiculous at this point. So, let’s talk about some of TMZ’s reporting. Yesterday, we covered Entertainment Tonight’s exclusive about the alleged text messages sent between Amber and Johnny’s then-assistant, a man named Stephen Deuters. In the text messages (reportedly from 2014) that ET published, Deuters and Amber were texting about an incident that happened the night before, where Depp kicked Amber in a drunken rage. Deuters told Amber that Johnny didn’t even remember doing it and that Johnny is “a little lost boy.” So what does TMZ have to report about those text messages? Johnny Depp’s assistant, Stephen Deuters, tells TMZ, the texts that were posted in which he allegedly apologized to Amber Heard for Johnny’s violent behavior are heavily doctored … and he never said Johnny attacked her. Deuters says he knows of no acts of abuse toward Amber at the hands of Johnny and has never made such a claim to anyone. He adds, Johnny has never been violent toward anyone he knows. Deuters says the texts themselves are suspicious because they don’t even show a date. Bottom line … he says he will testify under oath he never had a conversation about alleged violence with Amber. [From TMZ] First of all, it’s not like Amber doesn’t also have photos, witnesses and a video. Why are people acting like IF Deuters is telling the truth, then Amber’s story should be thrown out? Second of all, telling TMZ you will testify under oath about having no knowledge of abuse is different than actually testifying under oath and being cross-examined by a series of lawyers. Do you know what I mean? Lindsay Lohan can run to TMZ and tell them any story she wants (and she has, hundreds of times), but when it comes time to actually give testimony under oath, it’s a totally different story. Especially when Amber has made it pretty clear that she’s been holding on to two years’ worth of receipts which her lawyers will use to incriminate the dudes being sent out to muddy the waters on Amber’s claims. As for those receipts, TMZ is still playing fast and loose with whether Amber has filed police reports and whether filing a police report is the make-or-break evidence in whether Johnny abused Amber for years. Many abuse victims never file police reports and it doesn’t make the abuse any less real, that’s all I’ll say. Anyway, TMZ also says that Amber has had a “change of heart” about filing a police report because she “doesn’t want to bury him” and she doesn’t want to see Depp arrested. But “sources connected with Johnny scoff at Amber’s sympathy,” and claim that Amber has just done all of this so that Alice Through the Looking Glass would bomb at the box office. Seriously? Here are some photos of Johnny Depp in Stockholm on Monday. He’s still touring Europe with his band, the Hollywood Vampires. Do you think Team Depp’s crisis management just operates without him? Or is Depp on those conference calls, suggesting quotes that need to be placed in People Magazine? The only thing I know for sure is that Team Depp was hard at work on Memorial Day. Their current vibe is “let’s throw everything against the wall and see what sticks.” Which is the only explanation for two of the most blatantly pro-Depp pieces thus far, in People Magazine and TMZ. Some highlights: TMZ’s police sources are chatty. TMZ’s “law enforcement sources” want you to know that Amber Heard did not tell police officers that Johnny Depp had smashed her in the face with an iPhone. TMZ’s sources have already claimed that Amber was sporting no visible injuries and now they’re reiterating that Amber did not tell cops the whole story. TMZ ends their story with this: “We’re told Amber still has not filed a police report. If Johnny’s right and he never touched her … had she filed an official report she could be prosecuted for a felony — filing a phony police report.” Just what every victim of domestic abuse wants to hear, right? If you do come forward and tell (gossipy) police officers about your abuse, you could be prosecuted. Thanks, TMZ! Update: Oh, great, TMZ has another story about how Amber tried to “set up” Johnny by screaming for security when they were 20 feet away from each other. Amber and Johnny should have never gotten married. And now for the “derp” part of Team Depp’s media strategy, People Magazine has unnamed sources saying the most obvious things. Things like “they are just not good together. They had lots of problems before they got married, and should have never gotten married. Their personalities are just not compatible.” YA THINK? People’s source also says Heard caused a lot of “drama” and that she “exacerbates” his “jealousy issues,” and Depp is “very insecure when it comes to Amber.” I love that she’s getting the blame for “exacerbating” his unhinged jealousy. OH SHE MADE HIM JELLY. Then she totally deserved it, right? Amber is incredibly upset. E! News has one of the few pieces with quotes from pro-Amber sources. E!’s source says: “This has been incredibly upsetting for Amber but she knows she is doing the right thing. It has been very traumatic for her to finally speak out, but she needs to do what she can to protect herself.” The source also says that Amber “tried to hide what was really happening in the marriage from most of her friends because she wanted to believe that it would get better. That things would change. But ultimately they didn’t and so she had to do what she did to stop it.” I believe that. You know why? Because it happens all the time. The victim believes that things will change for the better. The victim is embarrassed that this is happening. The victim doesn’t think anyone will believe her/him. The victim doesn’t want to tell other people because then it becomes real. Meanwhile, Amber’s team finally responded to Doug Stanhope’s guest column in The Wrap (you can see our coverage here). Stanhope claimed that Amber was “blackmailing” Depp, and Stanhope based his accusations on stuff that Depp had told him. Amber’s lawyer tells The Wrap that Stanhope’s “allegations against Ms. Heard are absolutely and unequivocally false” and that the guest column “has no basis in reality and is nothing but the typical celebrity muckraking for profit.” Amber’s lawyer demanded that The Wrap take the column down and they’re currently speaking to their lawyers, but Amber’s lawyer told The Wrap: “It is highly offensive and disturbing that you would choose to publish it in the first place.” Photos courtesy of Fame/Flynet.

The details of Johnny’s alleged attacks, and of his behavior in general, are chilling. The court documents detail two incidents of abuse (update: another incident is referenced, see this article), each a month apart and the most recent one this Saturday. Johnny allegedly pulled Amber’s hair, threw things at her, and abused her. She states that he threw a cell phone at her this Saturday, hitting her in the eye. Photos of her bruises, including photos taken at her court appearance earlier today, support this. Amber maintains that Johnny has a substance abuse problem and has been abusive to her throughout their relationship: Johnny has been abusive for their entire relationship, has a drug and alcohol problem “During the entirety of our relationship, Johnny has been verbally and physically abusive to me “I endured excessive emotional, verbal, and physical abuse from Johnny, which has included angry, hostile, humiliating and threatening assaults to me whenever I questioned his authority or disagreed with him. “I live in fear that Johnny will return to (our house) unannounced to terrorize me, physically and emotionally, “Johnny has a long-held and widely-acknowledged public and private history of drug and alcohol abuse. “He has a short fuse. He is often paranoid and his temper is exceptionally scary for me, as it has many times proven to be physically dangerous and/or life-threatening to me. Johnny [sic] relationship with reality oscillates, depending on his interaction with alcohol and drugs. “As Johnny’s paranoia, delusions and aggression increase throughout our relationship, so has my awareness of his continued substance abuse. Because of this, I am extremely afraid of Johnny and for my safety… I am petrified…” Amber states that Johnny abused her on April 21 Heard claims that on April 21, he showed up to a birthday party at their home “inebriated and high.” As a “bad argument” developed, she claims he threw a magnum bottle of champagne at the wall, and a wine glass on her. “He then grabbed me by the hair and violently shoved me to the floor.” – From Radar and The AP Amber had not seen Johnny for a month until this Saturday On Saturday, May 21, Heard claims that she was having a conversation with two friends when Depp, 52, entered their downtown Los Angeles apartment. As the group of friends began to talk about the recent passing of Depp’s mom, the actor “began obsessing about something that was untrue” and became “extremely angry,” she states in the documents. In attempt to help relieve the situation, Heard began calling a friend who Depp was requesting to speak to, she states. “Johnny ripped the cell phone from my hand and began screaming profanities and insults at iO [the friend],” she said. “I heard iO yell at me to get out of the house. Johnny then grabbed the cellphone, wound up his arm like a baseball pitcher and threw the cellphone at me striking my cheek and eye with great force.” Heard submitted photos appearing to show a bruised eye as evidence. Heard says she covered her face and began to cry, then actor “charged” at her and “taunted” her, questioning if the phone actually hit her. “He then forcibly pulled back my hair as I attempted to stand up from the sofa,” she said. “I then yelled ‘Call 911′ – hoping it would be heard by iO who was still on the phone.” “Johnny continued screaming at me, pulling my hair, striking me and violently grabbing my face,” she continued. After a friend from next door entered the apartment with a key previously provided by Heard, Depp ran out of the apartment “smashing everything he could” with a wine bottle, Heard claims. She also submitted photos of damaged possessions. – From People [From People and Radar] Amber’s friend also submitted a declaration on her behalf stating that “Many times over the past few years, Amber has confided and complained to me about Johnny’s abusing her, both physically and verbally.” Some people are saying they don’t believe Amber based on the fact that the police found no evidence of a crime. Bruises take some time to appear, and Amber chose not press charges or provide a statement to police. She’s married to an incredibly famous man and she’s an actress, she probably weighed her options at a time when she was under extreme stress and decided not to bring attention to the situation.
