Kelly Rutherford to Elle: ‘I hope that this story will be an example to others’


Kelly Rutherford is breaking her silence after losing custody of her children to her ex husband, Daniel Giersch, following a ruling this November in Monaco. She covers the Romanian edition of Elle, and judging from the quotes that have been released so far, Kelly throws some shade but only speaks in general terms about her custody battle. She makes it sound like an epic battle in which she’s serving as a martyr for the cause, which is how she’s framed it to the press for years. The fact is that she kidnapped her kids and made a series of moves attempting to cut her children’s father out of their lives before she finally lost custody. Here’s what she said:

“Children need both parents. You do not want to make them suffer. I hope that this story be an example to others. … Now, I want them to be happy, to know that they are loved. No matter how long it takes this, I want them to know the truth.”

In the Elle article, Rutherford recalls her own parents’ divorce and how she realized if her mother was happy, “everything was okay in the world.”

“I know that if I find my peace, they will benefit,” she says of Hermes and Helena. ” talk about love because I hope that is what will make them stronger. When all this is over, I hope that they will look back and have the impression that it was not as bad as it was, actually. I do not want them to feel everything. There are good people and generous and funny.”

Moving forward, Rutherford says she hopes to use her story to raise political awareness of cases like hers and continue to work with her advocacy organization, the Children’s Justice Campaign.

“Perhaps activists will increase because of this situation,” she says. “I hope that something good will come of it.”

 

Kelly now gets €3,000 a month to visit her kids and has been posting Instagram photos of her vacations in Switzerland, Italy and France. She’s probably making some cash selling her story too, but if she tries to write a book or a screenplay it’s likely that Giersch will shut that down fast.

Kelly has posted a bunch of vague quotes on Instagram which reference her situation. She’s probably still under gag order for her case but she’s going to say what she can to get us to talk about her.

After years of a contentious, drawn out custody battle, Kelly Rutherford has lost custody of her two children, Hermes, nine, and Helena, six. In a ruling which was widely expected, a court in Monaco has awarded full custody to her ex, German born Daniel Giersch. Hermes and Helena have lived with their father and their paternal grandparents in Monaco since 2012. Rutherford can visit her children, but only by traveling to France and only for half of their school breaks. Up until this summer, they were allowed to visit their mother in America, in New York city where she lives, for several weeks. However Kelly refused to send the children back as scheduled, essentially committing parental abduction, and was ordered by a NY court to return them to Monaco immediately. This came after years of Kelly trash-talking Daniel to the press, claiming that rulings by a foreign court didn’t apply to her, and threatening to keep the children against court orders. Throughout it all, Giersch and his legal team remained very tight lipped, only issuing occasional statements and continuing to promote Kelly’s time with the children.

Kelly Rutherford’s ex’s lawyer: he will continue to promote Kelly’s time with kids

These are photos of Kelly Rutherford outside court in New York City yesterday, where she was ordered to surrender her two children to be flown to Monaco with their grandmother, who was waiting for them in court. This was a predictable outcome to a ridiculous situation she created, which caused needless stress and drama in her children’s lives. Kelly will likely do another interview soon where she cries and moans to the media about ‘Murica and how her children were deported. (I’m not going to treat whatever she says as breaking news, just FYI.) Meanwhile her ex, Daniel Giersch, has been nothing but a class act throughout this entire custody battle, despite how frustrating it must be to deal with this woman. (Thanks to Becks for commenting with this interview that Giersch did last year about an app he developed with the help of his kids. I’ve read it before but I wouldn’t have remembered it. He comes across very well.)

It’s worth noting that we only have the details from the first few minutes inside the courtroom because Giersch’s lawyers requested that the media not be present, in order to protect his children’s privacy. We could have heard the judge absolutely owning Kelly, but she surely wanted the press there anyway because narcissists want attention, good or bad. Instead we only know that she was told by the judge not to directly address her, and that the judge was angry that Kelly didn’t bring the children with her as ordered. Kelly’s lawyer claimed that this was to avoid the “media circus,” but really it was just another tactic by Kelly in this game she’s playing. At least it ended well, no one was hurt physically, and the children got to go home with their oma as they should have done several days ago.

In statements to the press following the ruling, Giersch’s lawyers said that the children’s transition went well and that they seemed fine. He also said that Giersch has not changed his stance on Kelly spending time with the children. Think about that for a moment. Kelly just kidnapped her own kids and has done interview after interview smearing her ex. She’s repeatedly tried to cut her children’s father out of their lives and she talks as if their life in Monaco doesn’t count, but he’s still saying that he’s going to let her see the kids. Here are some statements from various lawyers. Pay attention to the mild shade thrown by one of Kelly’s former lawyers.

How the children seemed in the courtroom
“Kelly’s failure to deliver the children on Thursday likely bought them a one-way ticket to Monaco,” Michael Stutman, head of the family group at Mishcon de Reya New York and a lawyer not involved in the case, tells PEOPLE. “Given Kelly’s initial failure to send the children back, showing up without them was probably the nail in her coffin.”

The children were later brought to the courthouse through a side entrance to say goodbye to their mom and head to the airport with Giersch’s mother.

“The kids didn’t seem to look like they missed a beat. They were happy, they kissed their mother goodbye, they were happy to see their grandmother, they had smiles on their face. And by the way, they’re two beautiful little kids,” Giersch’s attorney Ira Garr told reporters. “The only complaint they had is they really wanted to get back to playing; it was boring in the courtroom.”

“They just hugged and said goodbye, and she said she’d see them soon, and they were very, very easily transitioned to their grandmother, who they know very well,” said Robert Michaels, another lawyer on Giersch’s team.

“It was done very civilly,” Garr added. “Ms. Rutherford said, ‘Oh, you’re going to see Papa, and you’re going to go with Oma.’ And the kids seemed fine…”

There will probably be safeguards in place so Kelly doesn’t pull this again
“After this episode, we will be speaking with our client and his attorney in Monaco and maybe considering taking different measures about future visits to the United States, how the passports are held or whether the visits need to be supervised, because we don’t want a reoccurrence of this a year from now,” Garr said.

Kelly’s former lawyer shades her
“It’s really unfortunate that it came to this, and that Hermes and Helena were forced to say goodbye to their mother in a courthouse, rather than having a natural transition,” Robert Wallack, a lawyer who represented Rutherford in federal court last year, tells PEOPLE. “However, today’s proceedings played out exactly as expected, and it now appears the next chapter of this story will be written in Monaco.”


Daniel’s lawyer says he’ll continue to let Kelly see the kids
“We are pleased that the American judicial system has prevailed,” Giersch’s attorney Fahi Takesh Hallin told ABC News in a statement. “Daniel’s request to exclude the press today from the courtroom was granted, to protect the children’s privacy. In addition, his stance of promoting Kelly’s time with the children has not changed.”

As of now, Rutherford hasn’t issued a statement but she did speak briefly with the paparazzi outside the courtroom. TMZ has video of her leaving court. She was wearing sunglasses and looked like she might have been crying but she was smiling at the paparazzi and seemed to relish the attention. She said “I have no words at this moment” but when asked how she felt, she said “like any parent that lost their kids.

The next hearing for this case is scheduled for September 3rd in Monaco. Daniel is likely to get sole custody and Kelly will be lucky to have supervised visits, I think.

Kelly Rutherford’s Justice Campaign tries to right family court’s wrongs

In a few days Kelly Rutherford is supposed to return her children, son Hermes, 7, and daughter, Helena, 5, to their father, who lives in France. Kelly’s ex, German-born Daniel Giersch, obtained a judge’s permission in 2012 to have the children live with him overseas because he cannot legally return to the US. (Kelly’s lawyer has admitted notifying the State Department about Giersch’s immigration status and allegedly shady business practices, which is thought to be the reason his US Visa was revoked.) Kelly’s lawyers are trying to make a case that the family court judge in California illegally deported the children. Their efforts were shot down by a federal judge on Wednesday. Kelly has threatened to keep the children with her in NY, which would be a violation of court order. If she does that, she could be slapped with international kidnapping charges.

Amidst all this drama, Kelly has a new interview with Hamptons Magazine. She talks about staying in the Hamptons with her kids for the summer, and how she loves the area and spending time with her friends there. She also discusses her custody battle and her new charity, The Children’s Justice Campaign.

Do the children seem good? Are they happy?
They’re good, but they’re getting older so they’re much more outspoken about their feelings on the situation. They think it’s unfair: they’ve basically been told that I should move to France. I say, “Well, you guys are US citizens, and mommy’s a US citizen; your dad was living in the US when we got married and before we got married, and none of us are from France.”

I can see how your kids don’t understand it, because adults can’t understand how it’s possible that these children are now living in France with a man who has basically been exiled from this country.
Correct. And we still don’t even know why he was exiled from this country. Because he’s a foreigner, he’s actually being treated better, in some ways, than the tax-paying US citizen. Every evaluator said the children should be with me as their primary parent—that was ignored when the kids were sent to France. Since then, I’ve traveled 60 times back and forth.

Traveling 60 times back and forth has got to be so costly.
Basically everything I make goes to traveling. This is why I started the Children’s Justice Campaign, along with cofounder Patrice Lenowitz. It’s really to educate people about what’s really going on—if you bankrupt the mother before she can appeal and before you send her children to a foreign country, then she’s forced to just focus on trying to figure out how to see her children. To appeal a case like mine, it takes an enormous amount of time, and if there is anything even minimally wrong with the way the appeal is done, they can throw it out. Caring parents go in wanting what’s best for the kids, and are willing to negotiate, [but the way the system has been set up] is not in the best interest of the kids.

Rutherford said “we still don’t even know why [Giersch] was exiled from this country.” That is not consistent with People Magazine’s report that Rutherford actively worked to have her ex’s visa revoked. Outside the courtroom on Wednesday, she expanded on that, saying “My ex-husband got kicked out of the country and my children are with him. I’m not the one that got my visa revoked.”

Access Hollywood aired a clip yesterday of an older interview with Rutherford in which she similarly denied having a hand in her ex’s deportation. She said “I haven’t done anything personally to get him deported.” Notice how carefully she phrased that denial.

I checked out the website for Rutherford’s foundation, The Children’s Justice Campaign. While I have reservations about this case, this does seem like a worthy cause. One quote on the site from an expert stood out for me.

Although research confirms mothers make deliberately false allegations of sexual abuse less than 2% of the time, custody courts are giving the alleged sexual predator custody in 85% of these cases. This means, courts are sending a lot of children to live with their rapist. Barry Goldstein, Author and DV Expert

I don’t know if those statistics are accurate, but this really happened to a friend of mine. She lost custody of her children during her divorce after she accused her ex of sexually abusing her daughter. Her daughter told her this was happening, she had confirmation from a pediatrician that her daughter suffered injuries consistent with sexual abuse, and yet her ex’s lawyer called her crazy and the judge granted custody to her ex. You may think my friend did something to prompt this, that she must have been a bad mother in some way. I’ve known her for 20 years. I know she is telling the truth and that she is a good mother. I could tell you more about her case, but I don’t want to compromise her identity any more than I have.

So although I think that Kelly Rutherford is somewhat full of crap, I do think this is a worthy cause. So many times when parents lose custody of their children, people assume that they must be a bad parent or that the other parent must be “better” for the kids. People can be incredibly vindictive in a divorce and they often use their kids as pawns. Courts are not always fair or unbiased. I’m still not convinced that Kelly’s situation isn’t her own doing, though. There definitely seems to be some parental alienation going on. Does that mean that she deserves to have her kids live in another country? I don’t think any good parent deserves that, but sometimes things happen that way. I do wonder if there is more to this story than she’s telling us, but if that were the case wouldn’t she have made it public by now?
