Kesha loses injunction to break her contract with her alleged abuser Dr. Luke

In 2014, Kesha went into a facility to get help for a bad personal situation. She was drinking too much and abusing drugs, plus she had mental health issues, an eating disorder and she was dealing with some intense issues from her relationship with producer Dr. Luke. Later that same year, Kesha filed a civil lawsuit against Dr. Luke claiming that he mentally and physically abused her, drugged her and sexually assaulted her. She wanted to be let out of her recording contract. Dr. Luke countersued and claimed Kesha had made the whole thing up and that he would not be letting her out of her contract. Well, Kesha went to New York Supreme Court on Friday to find out that the judge had thrown out Kesha’s injunction. Basically, Dr. Luke won because this judge, Justice Shirley Kornreich, has a totally Pollyanna idea of how the music industry really works. Here’s part of People Magazine’s report: Kesha’s lawyers fought for a preliminary injunction that would allow her to record and release music without Dr. Luke, 42, whom she is also suing for allegedly drugging and raping her. The singer also alleges he has abused her verbally and emotionally for a decade. (Luke has vehemently denied the allegations through his lawyer, Christine Lepera, who has told PEOPLE: “Kesha and her mother are engaged in a campaign of publishing outrageous and untrue statements about Dr. Luke to third parties, including scurrilous and false statements of purported physical and mental abuse of Kesha.”) However, Justice Shirley Kornreich recounted that both Sony and Luke provided affidavits that they would allow Kesha to record without the producer. “Your major issue is your client is saying she cannot with Mr. Gottwald. Reading these papers, I notice that Sony and [Dr. Luke’s record label] Kemosabe Records say they don’t care if Gottwald has anything to do with anything with the recording,” the judge said to Kesha’s attorney, Mark Geragos. “They are willing to allow her to record without any involvement of Mr. Gottwald … and there are papers from Mr. Gottwald that say he will agree to allow her to record without his involvement … She doesn’t have to work with him.” But, Geragos responded, arguing that it was an “illusory promise…If he’s the one in charge of the company that does all the things to produce it … she can record right now, but no one is going to hear it,” he said, reiterating his assertion that Kesha’s future in music is in jeopardy because the typical lifespan of a pop artist’s career is short and that he believes her album won’t be promoted in an attempt to sabotage her career. Geragos added: “She has a window in which she can produce music, that it can get out there, that it can get promoted … His end game here is to destroy her… She is set up to fail.” The judge disagreed, citing the companies’ competitive objective to make money and the clear terms of the contract, which require Kesha to record six more albums. “You’re asking the court … to decimate a contract which was heavily negotiated and signed by two parties in an industry where these kinds of contacts are typical; you’re asking me to decimate all that law,” said the judge. “Now the other side has come forward to say, ‘We will let her record without Dr. Luke.’ I don’t understand your problem … It’s not in [the company’s] best interest to not make money and not promote a recording artist.” Upon the judge’s dismissal of the request for the injunction, Kesha broke down in tears, holding her face in her hands while mom Pebe and boyfriend Brad Ashenfelter did their best to console her the bereaved pop star excused herself from the room for a spell with a bodyguard. Lawyers also argued over dueling counterclaims, but the judge has yet to make a ruling, reserving to decide on the matters at a later time, perhaps when more evidence has been presented. [From People] “It’s not in [the company’s] best interest to not make money and not promote a recording artist.” How naive. The judge assumes that every person in the music industry has simple, straight-forward capitalist motives and that there’s not a history of music producers and labels actively thwarting a singer or songwriter’s career over personal or professional drama, regardless if those un-capitalist motives end up losing money. Even if you’re not familiar with the music industry in general, watch 20 Feet From Stardom and listen to Darlene Love’s story about how her early career was ruined because of a sh-tty contract and a producer who was a petulant sadist. That sh-t STILL HAPPENS. For a while on Friday, #FreeKesha was trending on Twitter, and many women in the music industry tweeted their support for Kesha – go here to see. Kelly Clarkson sounds like she has some stories about Dr. Luke that I would be interested in hearing. This feels like… the beginning of something. Like, Dr. Luke might be Cosby’d in public. Khloe Kardashian Has a Message for "Toxic People"

Khloe Kardashian is dropping truth bombs left and right these days. We’ve recently learned that Khloe likes dirty talk during sex and also that she once hid under the bed while Kris and Bruce Jenner got it on. Gross and grosser, we know. Now, in a manifesto posted to Instagram, the reality star has gone off on all the negative influences in her life. First, Khloe shared a photo of the following quote: “You never really see how toxic someone is until you breathe fresher air.” Then, without naming names or getting very specific, Khloe added in her own words: Let me remind you that we don’t need anybody’s approval to be happy in life. It’s on you to validate and accept your version of happiness. Take the control back. You choose your life. Don’t let anyone else decide for you. We are no victims to life. No prisoners. But we do become victims and prisoners to the people we choose to surround ourselves with. We tend to become content, passive and blind within our relationships. Whether it be a family member, business partner, friend or a lover. Out of comfort and possibly fear. The unknown will leave you stuck in a bad situation. Choosing comfort over your own happiness. Letting go means putting yourself first instead of holding on to that negative space you don’t deserve. Nobody deserves. Be OK with that. ‘God Helps Those Who Help Themselves. Khloe split from James Harden several weeks ago and has been spending a lot of time with estranged husband Lamar Odom. The two do not appear to be back together, however. Who is the “toxic” person or persons Kardashian is referencing with this diatribe? Your guess is as good as ours. But Kris Jenner has shown complete support for her daughter, sharing Khloe’s entire message and including as a caption: “God helps those who help themselves.” #repost @khloekardashian #proudmama #love #choosehappiness.” View Slideshow: Khloe Kardashian Memoir: 6 Things We Learned

Pope Francis & Donald Trump are beefing about immigration, Christianity

In this photo, imagine Pope Francis saying, “Talk to the hand, Dorito.” As you’ve probably seen the news coverage by now, you know that Pope Francis was on a multi-day trip to Mexico, where he said mass for tens of thousands of people, visited the border and fussed at some dirtbag who basically pulled him onto a dude in a wheelchair. As the Pope was concluding his Mexico trip, he did a press conference for the media outlets trailing him. He was asked about the Church’s stance on birth control, given the outbreak of the Zika virus and the medical recommendations that men wear condoms to avoid infecting their partners. Francis was basically like “I can’t technically tell people that it’s fine to wear condoms, but it’s not really all that sinful in this particular case.” Which, hey, is a good first step. Then Francis got a question about Donald Trump. And the Pope did not hold back. Inserting himself into the Republican presidential race, Pope Francis on Wednesday suggested that Donald J. Trump “is not Christian” because of the harshness of his campaign promises to deport more immigrants and force Mexico to pay for a wall along the border. “A person who thinks only about building walls, wherever they may be, and not building bridges, is not Christian,” Francis said when a reporter asked him about Mr. Trump on the papal airliner as he returned to Rome after his six-day visit to Mexico. Mr. Trump has staked out controversial positions on immigration, vowing to force Mexico to build a wall and also increase deportations. He has also made inflammatory comments accusing Mexican immigrants of being rapists and criminals. Asked whether he would try to influence Catholics in how they vote in the presidential election, Francis said he “was not going to get involved in that” but then repeated his criticism of Mr. Trump, with a caveat. “I say only that this man is not Christian if he has said things like that,” Francis said. “We must see if he said things in that way and in this I give the benefit of the doubt.” [From The NYT] Sure. And guess who has orange skin, a bouffant wiglet, no self-control and two thumbs? THIS GUY. So of course Donald Trump had to respond. Trump told a crowd in South Carolina that ISIS’s “primary goal is to get to the Vatican. That would be their ultimate trophy.” Is it though? And: “If and when the Vatican is attacked… the pope would only wish and have prayed that Donald Trump would have been elected president. Because this would not have happened.” Will Francis really be praying for that specifically? Trump also said: “No leader, especially a religious leader, should have the right to question another man’s religion or faith. They are using the Pope as a pawn and they should be ashamed of themselves for doing so, especially when so many lives are involved and when illegal immigration is so rampant.” [From Jezebel] Yeah. So Donald Trump and Pope Francis are boy-beefing. How does that make you feel? For what it’s worth, I don’t think Francis was really questioning Trump’s faith as much as Francis was making a larger plea for understanding and compassion for immigrants. But whatever. Benjamin Millepied left his position at Paris de Opera after just 15 months

I’ve been wondering why Benjamin Millepied had not joined his wife Natalie Portman on any of her red carpets lately, not even in Paris, which is where they live now. It’s not that I believe husband and wife should be joined at the hip at all times, it’s just Millepied has historically come out for many of Natalie’s red carpets, and it’s been a while since we’ve seen them together. Now I’m starting to get an inkling why – Millepied was dealing with his own drama at Opera de Paris, where he served as dance director since late 2014. On Thursday, Millepied announced that he was leaving his position and Opera de Paris for “personal reasons.” But there’s a mountain of French drama and shade going down. Dancer Benjamin Millepied announced Thursday he’s stepping down as dance director at Paris’ premier ballet company. Millepied’s efforts to innovate at the storied Opera de Paris have met mixed reactions since his arrival 15 months ago, and French media have reported tensions between him and some of the company’s star dancers. He said in a statement that he’s leaving for “personal reasons,” and that his role didn’t allow him enough time for “creation and artistic expression.” He sought to leave the Opera de Paris on friendly terms, appearing Thursday at a news conference with his successor, star dancer Aurelie Dupont, and Opera de Paris director Stephane Lissner. “I am convinced we’ve opened up things that are really important,” Millepied said. “The future is bright. What’s important for me is to create, to be inspired by the parts. That’s what motivated me in the ballet and today this position (the dance director position) isn’t for me, it doesn’t suit me,” he told a news conference. Speculation about a possible departure surfaced after a recent documentary in which Millepied said he still wasn’t satisfied with the level of dance. In an interview with Le Figaro in December, he said dancers should have more of a sense of entrepreneurship and fundraising — a concept foreign to many in France’s more traditionally funded cultural world. He was also quoted as saying, “To be a dancer is to express oneself, not to resemble a wallpaper pattern.” His predecessor, Brigitte Lefevre, played down any resistance to his unconventional ideas, saying instead that Millepied didn’t have the necessary management experience for the job. “Directing a great institution doesn’t happen by itself,” she said on Europe-1 radio. “You must have competence and energy to manage each post, from administration to rehearsal.” [From Page Six] So, he alienated dancers and staff by telling them they weren’t up to the job AND that they needed to be better at fundraising. And the woman who previously held his job is all, “He’s a crappy manager.” And Millepied is all “I better leave before they force me out.” There was similar drama when he left the New York City Ballet in 2011 – there was some talk that he was stretched pretty thin and incapable of being a hands-on director/manager. There was also some talk that Millepied has always been less interested in ballet and more interested in A) promoting himself and B) fundraising. Perhaps he should just seek a full-time fundraising position? So, does this mean Natalie and Benjamin will move back to America? Their Paris excursion was so brief! I also wonder if Anna Wintour regrets all of the hype she gave Millepied in Vogue. Photos courtesy of WENN.

Helen Mirren: ‘There is an extraordinary, extreme, right-wing voice in America’

Was I too nice to Helen Mirren yesterday? Probably. I like her so much, I do tend to ignore it when she makes problematic statements. My defense of her is usually along the lines of “well, now she knows, maybe she’s learned how to speak about this issue now.” Anyway, Britain’s Channel 4 released the video of their interview with Mirren, and she talks about a lot more than #OscarsSoWhite and the Academy. She was also asked about American politics. Just for the record, Helen has been married to an American for nearly 20 years, and I’m almost positive that she lives most of the time in America (I believe she and Taylor Hackford own homes in New Orleans and LA). Mirren is also an American citizen, likely through her marriage. So… I feel like it’s totally fine for Mirren to talk about American politics, considering she likely votes in American elections. And as it turns out, Mirren kind of hates Ted Cruz and to a lesser degree, Donald Trump. Whether the rise of Donald Trump signals a return of 1950s-style conservatism: “Yes, Donald Trump… and Ted Cruz. I suspect more Ted Cruz in a way than Donald Trump. I think the people who support Ted Cruz think Donald Trump is a little bit of a liberal. I think Donald Trump has a populist voice, massively populist, and that slightly demagogue, populist voice. But I think Ted Cruz is more the really old-school extreme right conservative.” The extreme right wing: “There is an extraordinary, extreme, right-wing voice in America – extreme. If that does get into power fully – in the Congress, in the Senate, in the White House and has all the power that it wants, I can’t imagine how the world would look. I think it’s a very, very frightening idea, myself. This whole idea of ‘making America great’ it seems to me it would actually be sort of the end of America as a great country.” [Via Channel 4, People Magazine] Helen has previously referred to Trump as “stupid,” but in this interview, it sounds like she’s more worried about Ted Cruz. I’m kind of feeling it too – the interviewer clearly wants to talk more about Donald Trump and hopefully takeaway a juicy, bitchy quote, but Mirren is more concerned about Cruz’s neo-McCarthyism. She’s right to be concerned. And personally, I’m still hoping that Donald Trump’s final gift to the American people is a spectacular takedown of Cruz. Please let it happen! Here’s Mirren’s interview. Harry Styles: Zayn Malik’s New Song SUCKS!

Earlier today, Zayn Malik dropped his debut solo single “Pillowtalk,” the first song off his upcoming album, “Mind of Mine.” Just hours after it was released, the track shot to the number one spot on the iTunes charts, thanks in no small part to an accompanying steamy music video featuring Zayn and his girlfriend Gigi Hadid. But there is one individual who is decidedly NOT a fan: Harry Styles. Zayn’s former One Direction band mate dissed the song big time, according to HollywoodLife. “Harry thinks it’s called ‘Pillowtalk’ because the song puts you to sleep,” an insider told the site. “He really doesn’t think that it is as good as anything that 1D has done with or without Zayn.” Well, the man has a right to his opinion, but it kinda sounds like sour grapes to me. Perhaps Harry is peeved that Zayn has been trash talking the band of late. Earlier in the week, Zayn confessed that he never really wanted to be a part of 1D and just sort of did it because it was “there at the time.” He went on to state that 1D’s music just wasn’t his “cup of tea,” and he thought the rest of the boys knew it at the time. Maybe someone needs to tell Harry that just because Zayn’s doing well doesn’t mean 1D can’t, too.  If, of course, they are actually still together. The band is currently on hiatus for an indefinite amount of time, and many fans are speculating that the band has in fact called it quits for good. Looks like Zayn’s jumping ship might’ve been one of the best decisions he’s ever made.

Amber Rose calls Kanye West a ‘f–king clown’: ‘You don’t bring in my baby’

Here are some photos of Amber Rose on Wednesday, after Kanye West’s Twitter rant directed at Wiz Khalifa (Amber’s ex) and after Amber body-slammed Kanye on Twitter. A lot is being said and written about Kanye’s constant disses towards Amber Rose following their breakup more than four years ago. Some think Kanye still has feelings for or about Amber. Some think Kanye is a petty child. I don’t disagree. But if I can just point out one small thing: Kanye called Amber a “stripper” in his Twitter rant because he thought Wiz made a derogatory reference to Kim (as it turned out, Wiz was just talking about weed). If Wiz or anyone else actually did slam Kim, I would expect Kanye to act the exact same way. None of which means that Kanye was in the right, especially when Kanye went in on Sebastian, Amber and Wiz’s son. So, Amber did an interview with the podcast Allegedly and she reacted to Kanye’s shade towards Sebastian. She apparently calls Ye a “f—king clown.” And more: “The thing of it is like, I would never talk about kids in like, an argument. It just shows the type of person he is. You know, even him saying stuff about my son, I still didn’t say anything about his kids. I’m not going to. That’s ridiculous. They’re innocent babies. You don’t ever, ever talk about a baby, ever. It just shows how f–king ridiculous he is.” “Listen, don’t talk about my kid. That’s all I got to say. Don’t talk about my baby. I wouldn’t have said anything if it was just between him and Wiz. That’s two grown men hashing it out. I would’ve kept it cute and just minded my business. You don’t bring in my baby. That’s so corny. That’s the second time you did it this week.” [From E! News] For sure. Don’t talk about the children. And she’s absolutely right: imagine the weeks of drama if Amber even mentioned North or Saint on Twitter or in an interview. Just to play devil’s advocate though… while Kanye absolutely should never had even referenced Amber’s child, the tweets felt more like Kanye was attacking Amber, that Amber was the target more than anyone else. He tweeted to Wiz: “I know you mad every time you look at your child that this girl got you for 18 years.” That’s a common theme with Kanye, that a “Golddigger” will get knocked up and you’ll be paying her for 18 years. That’s a slam against Amber. The other two references were “You wouldn’t have a child if it wasn’t for me” and “You own waves???? I own your child!!!!” I think “you wouldn’t have a child” is about how if Kanye hadn’t broken up with Amber, she never would have gotten with Wiz, etc. As for “I own your child”… I don’t even know what that’s about, I really don’t. Again, I’m not defending Kanye, but Amber acts like Kanye name-checked Sebastian specifically when really Kanye just needs to stop obsessing over Amber full-stop. Also: Amber wrote an essay about slut-shaming and judgmental people for Time Magazine – you can read her piece here. Photos courtesy of Fame/Flynet.
