Kesha’s appeal dismissed: ‘Every rape is not a gender-motivated hate crime’

Back in February, Kesha’s lawsuit/injunction against Dr. Luke was thrown out. The lawsuit was about Kesha’s right to break her contract with her alleged abuser, and how she wanted to record music away from Dr. Luke entirely. The judge threw out the case because the judge believed in upholding the contract, for whatever reason. It seemed like the judge was so Pollyanna to believe that everything operates in the music industry with perfect, profit-driven capitalism and no one ever has a personal or non-financial motive for any of their actions, but it may have been a legal judgment. Kesha and her lawyers filed an immediate appeal and her lawyers seemed to overreach a bit by comparing Kesha’s situation to “slavery.” Well, the same judge has just thrown out Kesha’s appeal, meaning Kesha is still contractually tied to Dr. Luke. Kesha was delivered a huge blow Wednesday by a New York judge who dismissed nearly all of the singer’s counterclaims in her ongoing lawsuit against Dr. Luke. The star previously accused the producer of drugging, raping and abusing her during her career. The hitmaker, in turn, has vehemently denied the allegations and countersued for breach of contract and defamation. The singer has been adamant about being released from her contracts with Luke because, she wrote in February, “This is about being free from my abuser.” On Wednesday, New York Supreme Court Justice Shirley Kornreich cited lack of jurisdiction and failure to procure facts proving the allegations when tossing out the majority of Kesha’s counter claims. The pop star’s claims invoking human rights laws were dismissed – alleging the plaintiffs “discriminated against [her] based on her gender” – were dismissed because “Kesha failed to plead that any of the alleged discrimination occurred in New York State or City … the court has no jurisdiction over” the claims, the judge wrote. As for the civil rights, or “hate crime,” laws, the singer had to prove Dr. Luke “harbored animus towards women or was motivated by gender animus when he allegedly behaved violently toward Kesha,” the judge stated in court documents obtained by PEOPLE. “Every rape is not a gender-motivated hate crime.” According to Justice Kornreich, the only allegations Kesha made that meets the elements of “physical violence or property damage” were claims that Luke assaulted her on an airplane and raped her in his hotel room. But “the claim is time-barred,” writes Kornreich. The singer’s claim of “intentional infliction of emotional distress” was also dismissed because the judge believes her allegations “do not meet the strict pleading standard. Her claims of insults about her value as an artist, her looks, and her weight are insufficient to constitute extreme, outrageous conduct intolerable in civilized society,” Kornreich wrote, adding the instances that would constitute as intentional were “time-barred.” Aside from throwing out her claims, the judge also denied Kesha’s request to make amendments. “Kesha’s request for leave to amend the CCs is denied because there is nothing in the record from which the court can determine whether the amendment would be meritorious,” state the papers. [From People] Ever since I read about this ruling last night, I’ve been thinking about the judge’s words: “Every rape is not a gender-motivated hate crime.” True or false? Is every rapist a misogynist? Is every rape a hate crime? It’s not just a linguistic argument, it’s a legal argument and one that I would like to see more of. I have long believed that we should consider mass shooters to be “terrorists” regardless of race. Can we not say serial abusers of women are hate-crime assailants or misogynistic terrorists too? Anyway, Kesha’s still got legal options. In Touch: Drew Barrymore & Will have been separated for a year

Then of course they announced last Friday that they were formally splitting and planned to divorce soon. In Touch now claims that Drew is the one who decided to separate after she had a personal revelation during her 40th birthday vacation that she was unhappy in her marriage. This is consistent with everything we’ve heard in major celebrity outlets, and it’s not surprising that there’s a specific moment when Drew decided to leave. That seems so much like her. In Touch magazine, on newsstands tomorrow, is reporting that a turning point for Drew came in February 2015, when she turned 40. She took a trip to Hawaii and realized how unhappy she was. “Inside, she was crying,” a family insider tells In Touch. “She felt like she wasn’t in control of her life anymore.” Things got worse quickly. “Drew began contacting her attorneys in the fall of 2015,” the family insider adds. “She tried to keep it together for as long as she could, but their relationship was broken beyond repair.” “Part of the problem is that Drew and Will are total opposites. He’s very organized and used to keeping a schedule, and Drew’s flighty, always late and is truly a wild child at heart,” the family insider tells In Touch. “Because she came from a broken family, Drew tried so hard to play the devoted wife role. She desperately wanted that sense of family and stability, and for a while she thought she found that in Will.” But in 2014, she returned to the big screen with the Adam Sandler dud Blended. “At that point, she wanted to ramp up her career again and Will didn’t want her to,” says the family insider. “They fought bitterly about it.” Adds a source close to Drew, “There was no infidelity, nothing dramatic like that. This has been going on for a long time. They’ve been working on their issues. In the end, they feel like, ‘This is a bummer. We tried.’” The couple remains on good terms. “They are still living together,” says the source close to Drew. “They have places in NYC and in LA. Both are in LA right now, living in the same house.” [From In Touch] That sounds about right, and we’ve heard it several times now – Drew was unhappy, she did some soul searching, they tried for a while and ultimately ended it. It’s sad but it happens to so many couples. They seem to be putting their kids first and focusing on what matters. E! also has an insider story about Drew, and it reinforces the narratives in US Magazine and People this week. Their insider says that “This was a slow burn. It was not a decision that they came to over night. They worked on things for a long time and have had time to adjust.” As I mentioned yesterday, this sounds so much like all the stories around the Garner-Affleck split and I don’t think that’s a coincidence. Drew’s longterm friend, Cameron Diaz, was on Andy Cohen’s XM show promoting her new book recently. Andy asked her if she’d reached out to Drew after hearing about her split and she responded in general terms, but it sounds like she has. She said “Everybody pulls the wagons around, you know, our friends, whoever needs us in whatever point in time. Even if it’s something that the public doesn’t know about. Internally we’re all going, like, ‘OK, who needs us now?’ And that really is, I think, a major part of the connectivity we need. We need to keep those things connected.” So it sounds like Cameron has known for some time that Drew is having relationship trouble. Rihanna Releases Crazy Hot New Music Video

WARNING: The following music video may cause you to get drool all over your keyboard. Proceed with caution. And maybe with a cold shower at the ready. Rihanna has dropped the official music video for the track "Kiss It Better" … and let's just say it's pretty clear after viewing just why Kim Kardashian doesn't want Kanye West to be talking to Rihanna any longer: Because she's really hot! The footage features Rihanna writhing under a sheet, only for a pair of dice to direct the audience to the part ths artist apparently wants kissed better. And these parts are not always the superstar's lips. If you know what we mean! The video was shot in black and white, which adds an artistic element to the sexy element, and it was helmed by director Craig McDean. At various points, Rihanna switches from her birthday suit to some VERY revealing lingerie, along with a black-and-white pinstriped suit. She's never looked better, to be honest. Rihanna wears shorts, Miu Miu fur to Black Girls Rock: ridiculous or amazing?

For six years now, BET has been doing an event called Black Girls Rock! It’s about promoting positivity with African-American women and black women and showing young women of color that there are some amazing role models in their community. Considering the consistent underrepresentation of women of color in the media, I think the event is pretty great. In years past, Michelle Obama has even come out for it. And this year, Rihanna and Hillary Clinton came out. Clinton gave a speech about her African-American female role models – you can read her speech here. Rihanna was there because she picked up the Rock Star Award. In the past month, we’ve gotten more red carpet and paparazzi photos of Rihanna than we’ve had in the previous year. When she amps up her promotion, she really brings it. While I’m happy about all of the new Rihanna photos, I do wonder the interest level? Like, do you guys want more Rih-Rih? Do you want more fashion posts and street-style posts about Rihanna? I’m really asking – honk if you want more Rihanna! For the Black Girls Rock event, Rihanna wore this… unusual ensemble. With that face and that body, she can pull off nearly anything, but this outfit did leave me with a “???” thought bubble. She wore an oversized gingham blouse, shorts and a giant fur coat by Miu Miu. While I knew that Rihanna doesn’t have a problem with wearing fur, the choice of wearing fur to this event – and wearing fur over shorts and a blouse – is really strange. Rihanna also made a nice, tearful speech for her Rock Star Award: “Thank you so much for celebrating us in a world that doesn’t celebrate us enough. The minute you learn to love yourself, you will not want to be anybody else. Role model is not the title they like to give me…but I think I can inspire a lot of young women to be themselves and that is half the battle. It does feel like her biological clock has started ticking and she’s thinking more and more about settling down and starting a family. I genuinely believe she will be a kickass mom. Star: Evan Spiegel wants Miranda Kerr to sign a Draconian prenup

This might be the feel-good story of the week. Not all golddiggers are equal! For every Jerry Hall – who managed to get her billionaire down the aisle in less than seven months – there is a Miranda Kerr, who toiling away for something like 10 months… and still no ring! I personally think this is Miranda’s second Golddigger Fail – she was trying to land James Packer back in the day, but it fell apart. And now Mariah Carey has landed Packer, and Miranda is trying to play it like she’ll just wait out her young billionaire boyfriend for however long it takes. Star Magazine says that Evan Spiegel is thinking marriage. But he’s also thinking “ironclad prenup.” After months of marriage talk, Miranda Kerr was expecting a ring from her boyfriend, Evan Spiegel, but the world’s youngest billionaire, 25, gave her an early draft of an ironclad prenup to read over instead. “Evan’s lawyers are advising that Miranda walk away with nothing if they get divorced,” dishes a source, noting that the Snapchat CEO is worth a staggering $2 billion compared with the model’s $38 million fortune. “Miranda started laughing when she heard what Evan was proposing. Then she realized that he was dead-serious. I can only imagine the look on her face!” And no matter how persuasive Miranda might be, her future fiancé isn’t budging. Taylor Swift in a YSL jumpsuit at the iHeartRadio Awards: try-hard or cute?

I could post 50 photos of Taylor Swift’s pose-harding at the iHeartRadio Awards last night and each photo would make me laugh. It’s not that her outfit or her styling looked ridiculous, it’s just that she was taking the posing SO seriously. She was posing her ass off on this carpet and it was amazing. She really wanted the photographers to get her Saint Laurent Fall 2016 jumpsuit from every angle, especially the butt shots. As for the Saint Laurent jumpsuit … while Taylor has a great figure, I feel like this is sort of unflattering on her. I would have loved to see her in something else from Saint Laurent, like one of the more menswear-inspired looks. Taylor was joined at the awards show by her BFF Selena Gomez and her (Taylor’s) boyfriend Calvin Harris, also known as Adam Wiles. While Calvin and Tay didn’t walk the carpet together, they did sit together and Taylor did thank him during one of her many trips up to the stage to collect her awards, saying: “For the first time, I had the most amazing person to come home to when the spotlight went out and when the crowds were all gone. So I want to thank my boyfriend Adam for that.” Taylor took home awards for Best Tour, Best Female Artist and Album of the Year. Calvin took home the award for Dance Artist of the Year. Taylor also said something about how this was her last awards show for a while. Sure. She’s probably going to spend the spring and summer planning her wedding!!! Emma Watson needs a better explanation for her Lancome skin-whitening ads

Several years back, Emma Watson got a lucrative beauty contract with Lancome. She became one of their “faces,” and she appeared in print ads for many different Lancome products. Her contract is done at this point, and I have no idea if Lancome simply didn’t renew it or if Emma just didn’t want to be in their advertising anymore. But this week, people started discussing a print ad from 2013. The print ad (seen above) features Emma as the “face” of a skin-whitening Lancome product being sold in Asia. As you can imagine, the reaction was really, really bad. People have been itching to write off Emma as just another non-intersectional white feminist, and this gave them a perfect opportunity. Beauty companies have long sold “skin lightening” products in countries with large (or nearly exclusive) populations of non-white women. Lancome is not the first nor will they be the last. Colorism, racism and the white-dominated hierarchy of beauty standards all come into play when we talk about skin lightening. We’ve talked about it before too, with Freida Pinto talking openly about her disgust for Indian society’s obsession with getting lighter skin. Anyway, the conversation centered around Emma and how she’s basically Peak White Feminism because she has profited from selling this bulls—t. So Emma’s publicist came out and this was literally the only statement made. “I cannot comment on my client’s previous contractual arrangements with Lancôme. However, my client no longer participates in advertising beauty products, which do not always reflect the diverse beauty of all women.” [Via People] If it sounds like Emma’s people are sort of throwing Lancome under the bus, that’s because I think they are. I also think there’s a very real possibility that Emma’s images were used by Lancome for skin-whitening products without her explicit or implicit endorsement. Oh, and a Lancome representative told People: “Blanc Expert was created by Lancôme 20 years ago. It helps brighten, even skin tone, and provides a healthy looking complexion. This kind of product, proposed by every brand, is an essential part of Asian women’s beauty routines.” [Via People] That pisses me off more than Emma’s rep’s statement. Skin-lightening products are not now and never have been an “essential” part of Asian women’s beauty routines and f—k you very much for saying so, Lancome. As for Emma and white feminism… I find Emma less harmful than someone like Lena Dunham, honestly. I think Emma is trying and she’s attempting to educate herself beyond the narrow feminist beliefs she held just a few years ago. Does she deserve some backlash? Sure.
