The White Stripes sue Donald Trump for using ‘Seven Nation Army’

Another week, another lawsuit against Donald Trump for using music without permission as part of his campaign. This summer has seen Defendant Don rankle artists from across many music genres: pop (Celine Dion), soul (Isaac Hayes), disco (ABBA), and alt rock (Foo Fighters), and joining them now is alt/garage/indie rock duo The White Stripes. The Trump campaign released a video in August cued up to the distinctive riff of “Seven Nation Army,” and when Jack White caught wind of it he let it be known that the message comin’ from his eyes says, leave it alone. And if he catches it comin’ back his way he’s gonna serve it to Don. And that ain’t what Trump wants to hear, but that’s what Jack’s done. He’s goin’ to Wichita— no, no, that’s it for the lyrics! But yeah, Jack and Meg White are suing Trump’s broke ass for copyright infringement:

The White Stripes are suing former president Donald Trump for featuring their acclaimed track “Seven Nation Army” in a video on social media, which they allege was used without their permission last month in a breach of federal copyright law.

In a lawsuit filed Monday in New York, Jack and Meg White accused the Republican presidential nominee of trying to burnish his public image and generate financial support for his campaign “on the backs of the Plaintiffs,” constituting a “flagrant misappropriation” of their work.

The lawsuit is the latest copyright case to plague Trump’s presidential campaign, raising questions about how to adjudicate allegations of copyright infringement in the digital era. Copyright lawyers say the cases could set an important precedent on the use of popular music in political campaigns.

The Whites, who are seeking unspecified damages, said that the fact that they “vehemently oppose the policies and actions taken by Defendant Trump” only made the alleged violation all the more offensive to them.

A spokesman for Trump’s 2024 presidential campaign did not immediately respond to an emailed request for comment early Tuesday.

According to the lawsuit, which names Trump, his campaign and Deputy Director of Communications Margo Martin, the defendants published a video of Trump boarding an aircraft for campaign stops in Michigan and Wisconsin with the riff of “Seven Nation Army” playing for the duration of the video. “Defendants impermissibly synchronized the riff from [“Seven Nation Army”] with that footage,” the lawsuit alleged.

Jack White shared the X post by Martin on his Instagram account on Aug. 31, promising the lawsuit and saying, “Don’t even think about using my music.” The post was not visible on Martin’s account, nor Trump’s, as of Tuesday.

The White Stripes’ case underlines the complexity of music copyright law, says U.S. intellectual property lawyer Jason Rosenblum. “If you want to use music in a video, you need a synchronization license,” he said in an email Tuesday. Such a license is acquired through a different process than how rights are negotiated for public performances of music. Synchronization licenses typically require direct negotiation with whoever holds the rights to the recorded song, he added, usually the publisher or musician.

“If Trump’s campaign or whoever posted the video didn’t get those rights, the White Stripes should have a strong case against them,” Rosenblum said, although he cautioned that these cases aren’t always clear cut and that he wasn’t familiar with the details of this specific claim.

You see, there’s always a bright side to litigation: Trump’s endless stream of lawsuits will finally set much-needed clarifications and precedents for US music copyright infringement law, specifically as it pertains to the digital landscape! Huzzah! I realize that Trump isn’t single handedly selecting the playlist for his rallies and propaganda, but I do find it funny that he’s doing legal battle over these songs, when I don’t really get the impression that Trump is much of a music man himself? I mean, anyone who’s heard his meandering, plotless, rhetorically-painful “speeches” knows the man has no musical ear whatsoever. So why doesn’t he just pull from the Kid Rock, Amber Rose and Jason Aldean catalogs and call it a day? And those suggestions are just off the top of my head; I’m sure if Trump thought about how to license music without getting sued, he could come up with his own concepts of a plan.

Jennifer Aniston v. Julia Roberts: who rocked the best ‘business shorts’ suit?

Here are some photos from last night’s LA premiere of Mother’s Day, the latest Garry Marshall-directed holiday monstrosity. In this post, we are going to be discussing Business Shorts/Cocktail Shorts and whether they are ever a good idea. First, let me say – I don’t think Jennifer Aniston and Julia Roberts meant to both do Business Shorts for the premiere. Meaning, I think if Jennifer knew that Julia was going to do shorts, Jen probably would have gone with a cocktail dress. The fact that they both did Business/Cocktail shorts is amusing to me. Also amusing? Julia and Jennifer didn’t pose together on the red carpet at all. That just shows you Julia’s Alpha-Dog tendencies, just my opinion.

We’ll start with Jennifer Aniston, who wore this sort of deconstructed Armani suit which, yes, involves shorts. At first, I just saw the top half and I didn’t care for it, but the whole look is much better. The cut-off on the jacket/shorts is very flattering to her figure and her body looks great. I think her face looks less filler’d and Botoxed too. Now if we could just stop with the hair-in-the-face styling.

As for Julia, she wore this shorts-suit from Rag and Bone. While Julia looks nice, I feel like this is millionth time she’s tries to make Business Shorts a thing. And I’m just not feeling it. I get that she has crazy-long legs and she wants to show them off. But why not just do a short cocktail dress? I don’t know, I just feel like this wasn’t her best choice out of all the available options.

Prince Harry looked amazing in a tuxedo at the Royal Variety Performance

Prince Harry did his first-ever Royal Variety Performance on Friday. And by that I mean that for the first time ever, Harry was the “royal guest” of the Royal Variety. In years past, it’s been Prince William, Duchess Kate, the Queen or more often than not, Prince Charles and Camilla. It seems that other than some forced hand-wringing coming out of the Cambridges’ press office, Harry is still popular, in demand and perfectly fine at flying solo to big events.

The Royal Variety was hosted by Jack Whitehall, who is incredibly annoying if you’ve ever seen his stand-up. Whitehall did a lot of jokes about Harry being a party prince and how he’s the kind of friend who would shave off someone’s eyebrows if they passed out drunk. Harry also got to spend some time with One Direction, Kylie Minogue, Little Mix and more. The biggest headline seems to be that Prince Harry met Harry Styles and everyone loved it. Prince Harry asked Styles: “When was the last time you had a haircut?” Styles told reporters that he took it in stride, and that at some point, he’ll be cutting his hair for charity. Oh, and Prince Harry kissed Kylie Minogue on both cheeks and now I’m wondering if Kylie is one of the discreet “older women” that Harry spends time with on the down-low.

Grammy noms announced: Beyonce, Ariana, Miley, Taylor, Iggy & more

The first wave of Grammy nominations rolled out this morning. Pharrell and Ed Sheeran announced the list on CBS This Morning, and you can watch the video here. These aren’t all the categories, but they’re the big ones. The usual suspects popped up on the list of course. There are some surprises too. Everyone knew Beyonce would snag a nomination, but Miley’s on the shortlist for Bangerz as Best pop album. I really thought she’d get shut out of the awards process, yet she’s receiving recognition. She won’t win though. The award will probably go to Sam Smith, don’t you think? Here’s the rundown:

Here’s another shocker: Iggy Azalea is up for Record of the year. Nicki Minaj must be seething about that one, but she’ll probably hold her venom intact until the Rap category is announced. Other than that, this list isn’t too controversial. I’m glad to see Jack White grab a spot, but is Paramore really considered “rock”? These categories are so whack. The rest of the list should be interesting, whenever it comes out. Taylor Swift will probably grab a few more nods. Ugh, Coldplay.

Duchess Kate wants reporters to follow a dress code she has never adhered to

There are a bunch of new stories about Prince William, Duchess Kate and the other royals from the past few days, but this post is just for Will & Kate! I think I’ll probably do another royal post on Monday, or maybe even Tuesday. First up in this royal round-up: William and Kate finally hired a PR person. Like, a real person with real-world experience in crisis management and public relations. Considering the last guy left very quickly after he came in, and given the more frequent reports of William’s constant bitchery, I’ve got to wonder how long this new guy is going to last. Plus, the new guy is an American!! OH NOES. The Yanks are invading the royal press office! Anyway, the guy’s name is Jason Knauf and he previously worked for RBS and the New Zealand government. You can read more about him here – his CV doesn’t seem all that impressive, but it also sounds like being in charge of media relations at RBS was akin to being captain of the Titanic. I say Knauf lasts less than a year.

Knauf’s first duty seems to be preparing the colonies for the invasion of William and Kate. Last week, the monarchy’s website sent out a reminder to all journalists covering Will and Kate: reporters much adhere to a “dress code.” The dress code seems relatively simple for professional people – no jeans or sneakers, men must wear a jacket and tie and women must wear pants or a skirt suit. What’s funny (to me at least) is that kind of simple, professional dress code is something Kate has never been able to adhere to. She is constantly wearing the wrong outfits for dress-code specific events, nevermind all of her “Marilyn Moments.” And if we see her in jeggings during a public event one more time, I think the journalists should revolt. Why would Kate be allowed to wear painted-on jeggings and a member of the press can’t wear comfortable sneakers?

Also on Knauf’s to-do list: trying to make Will and Kate seem like they actually spend time together and like they have a completely normal, romantic marriage. People Magazine managed to get this little story in:

When British florist Paula Pryke received her Order of the British Empire from Prince William last week, he confessed his love for pretty blooms – and how much he enjoyed treating his wife Kate to beautiful flowers.

“He told me that he liked buying flowers for Kate and how much she loved flowers,” Pryke tells PEOPLE from her base in London’s New Covent Garden Market.

Of course, it’s not the first time William has shown his romantic side. Just seven months after Prince George was born, he whisked Kate off for a luxurious week-long stay at an exclusive resort in the Maldives. And let’s not forget that in true princely style, he carried his mom Princess Diana’s engagement ring in his backpack all the way to Africa to propose to Kate back in 2010.

Pryke, who has worked with the royal family as well as numerous celebrities during her 30-year career, says receiving her award from William on Friday was “very exciting.”

William buys flowers for Kate? Er? Okay. I mean, no shade. I like getting flowers too and it’s a simple, lovely gesture. But it does seem like a little piece of royal propaganda. Look, they’re so normal!

Last thing – Jack Whitehall is a young British comedian and he performed at the Variety Show, the same one that Will and Kate attended. During his set, Whitehall joked about how he went to school with Kate (although Jack is several years younger than Kate) and how she was “the one who got away” and he had a “crush” on her at school. Apparently, William came up to him later and joked about how Whitehall was “flirting with my missus.” Whitehall told Graham Norton: “William came over and he was very funny, he was very nice but very passive aggressive [and said] ‘Oh, so you were flirting with my missus? Oh no that was very funny!’” LOL, describing William as passive-aggressive… amazing.

Jack White continues his Black Keys feud, complains about the ‘sound bite’ age

Last week, I covered the first excerpts from Jack White’s bitchy Rolling Stone interview. Jack complained that Meg White never reciprocated his excitement over breaking ground with White Stripes’ music. My take was that Meg has always had an understated personality. She doesn’t get overly excited about stuff, and she suffers from social anxiety. Jack seemed offended that Meg didn’t bounce off the walls when confronted with his genius. It also sounded like Jack missed Meg.

The rest of the RS interview has surfaced, and Jack is in fine snarky form. He whines about the Black Keys again. I’m always fascinated when rock gods get into fights with other rock gods. That statement would probably upset Jack White, blues god, who is behaving like he’s the only blues god that ever existed.

Jack’s been feuding with the Keys for years. He was upset with ex-wife Karen Elson for letting their children be in the same school classes with Dan Auerbach’s kids. Jack has a real problem with the Keys. That school-kid spat happened over a year ago, but Jack is elaborating on the issue with Rolling Stone. He basically thinks the Black Keys copied the White Stripes. Here is Jack’s explanation:

“There are kids at school who dress like everybody else, because they don’t know what to do, and there are musicians like that, too. I’ll hear TV commercials where the music’s ripping off sounds of mine, to the point I think it’s me. Half the time, it’s the Black Keys. The other half, it’s a sound-alike song because they couldn’t license one of mine. There’s a whole world that’s totally fine with the watered-down version of the original.

“Some people will hear that and say ‘Oh, Jack White thinks he’s the first person to play the blues.’ But certain acts open up a market for a certain style. Amy Winehouse: Did she invent white soul? Wearing a beehive? No. But she did something brand new and fresh, altogether as a package, and you see who’s in her wake, from the Duffys to the Lana Del Reys. Adele selling 20 million records? That would not have happened if Amy Winehouse was alive. The White Stripes did the same thing, and in our absence, you’re gonna find someone to fill that. And you get a band like the Black Keys, who said they never heard of the White Stripes? Sure.”

I don’t know why Jack is picking upon Adele, and I don’t know if anyone remembers Duffy. She was big for a year or so, and I agree that Duffy followed in the lead of Amy Winehouse. Adele is different. She is one of a kind. Not every retro-based act copies from other retro-based acts. I don’t think the Keys are Stripes copycats. Jack doesn’t consider that his bluesy influences might also be the same artists who influenced the Keys. I also think the Keys borrow a lot more from funk-rock artists like Jimi Hendrix than they take from the blues. Then again, I’m not an expert on musical genres. Feel free to educate me.

The Black Keys seem pretty perplexed about Jack White’s problem with them. Patrick Carney admits that White, “obviously sounds like an a–hole,” but he and Dan Auerbach both “actually feel embarrased for him.” The Keys are referencing Jack’s non-amicable divorce and custody battle with Karen Elson in relation to outlets like TMZ, who leaked Jack’s private emails with Karen.

I think Jack has a problem with the Keys because he truly DOES think they copied the Stripes. Jack let his belief seep into his divorce battle, and the band-fight continues long after the custody fight ended. Rolling Stone won’t let it go, and both Jack and the Keys keep talking. Jack decided that things went far enough, and he posted an “apology and explanation” on his website:

Why Jack said all that crap: “I felt in a way forced into talking about very private opinions of mine that are very much in the realm of ‘behind the curtain’ show business conversations. Remarks I’ve made about the state of the music business and about how certain acts create new markets in the minds of music lovers are also very difficult to clarify without exacerbating the issue. In an attempt to not give the music magazine Rolling Stone a ‘no comment,’ because I thought they would use that to convey some sort of pettiness on my part, I decided to try to explain a tiny portion of what they were asking. I should’ve been smarter to know that it would be pointless to use comparisons like I did to readers who most likely don’t understand the scenario and that my words would seem very negative in nature. That’s not me trying to sound like I’m above anyone, it was just ‘shop talk’ and it sounded a lot more negative than it was meant to.”

He loves Adele: “I wish no slight to the talents of Winehouse, Duffy, Lana del Rey, and Adele. All of whom are wonderful performers with amazing voices. I have their records and I hope for more success for them all as the years go on. They deserve all they’ve gotten. And, I also would love to state that I personally find it inspiring to have powerful, positive female voices speaking out and creating at all times in the mainstream.”

On Meg White: “She is a strong female presence in rock and roll, and I was not intending to slight her either, only to explain how hard it was for us to communicate with our very different personalities. This got blown out of proportion and made into headlines, and somehow I looked like I was picking on her. I would never publicly do that to someone I love so dearly.”

Jack blames the tabs & blogs: “We live in a sound bite, sensationalized age. The ‘non apology’ has become a lawyer’s dodge for celebrities themselves, given to a public that usually doesn’t want to hear it as it disrupts the tabloid ‘dirt’ that we all want to occur. Because the conversations I’ve had that have been made public and recontextualized are difficult to clarify without making it seem even more petty and strange, this is an apology to anyone I’ve offended with my comments about my creativity, their creativity, and the music business in general. I wish for a long, fruitful, healthy family of creative people to continue to grow around me and the musicians I work with, the city of Nashville, America and the world of listeners that this music can reach.”

I do give Jack credit for not saying, “I’m sorry IF you were offended.” He realizes that he said some douchebaggy things. But he still blames the “sound bite, sensationalized age” when he doesn’t realize that sound bites have always existed. He also argues that what he said has been “recontextualized,” which sounds a bit Goopy. Here’s the thing — the White Stripes became huge right before blogs became huge. Jack has no idea how to deal with bloggers. He’s only used to select outlets publishing quotes with no reaction from the void.

Jack is fine with getting quoted by Rolling Stone, and he’s alway spouted off to the trade pubs. What Jack can’t deal with bloggers reading his quotes and interpreting them. Jack doesn’t like the internet because he’s getting called on his sh-t. He wants to have his bluesey cake and to eat it too. Another example? He complained to Rolling Stone about how fans bring iPhones to shows, but Jack forgets that he designed a custom iPhone case a few years ago.

Jack? If you’re reading … the internet is here to stay. Don’t fight it. Adapt. The internet will love you right back.
